Hi

We are applying for my immigration based on marriage to USC. I came to US as an F-1. I finished my studies and got OPT EAD. After a year I extended OPT for another 17 months (STEM extension in place since 2008/2009 i guess) and got another EAD for the extension. Then I applied for the H-1B but got rejected and now I am back to F-1 and working and studying on CPT.

Questions I have:

(1) In I-765 question 11 it asks for Date(s). Should I put both EAD acceptance dates or just the last one(EAD Extension)?

(2) Also on the very top it asks for "I am applying for". My guess is it should be "Permission to accept employment" since this is based on different category (C-9) not the "Renewal". Am I right?

(3) Currently I am on CPT, working and studying. Is this going to be a problem since I had to maintain my status because of denial of H-1B? :unsure:

I would really appreciate some help.

Not sure about the others-though it'd likely be safe to put the last date of EAD acceptance and not all the previous ones, but I'm sure putting them all down couldn't hurt either. Sorry I couldn't be of more help!

Thanks J-D for your quick response. That's what I thought initially to just put the last one. Then I thought anyways I will attach copies of both EADs so why not put the dates too. Since Date field only accepts one date, J-D, do you know if it's ok to write the other date by hand? In some other forms too father's Name field was kinda short so I was thinking to write remaining 2-3 letters by hand. Is that ok?

Yes, since you're attaching copies of both EAD's then it's probably a good idea to list both dates of acceptance. I think it's fine to add something by hand...I added a couple things and haven't received any trouble from it.

And I think it's totally fine to add those last couple letters of your Dad's name by hand. As long as the writing is neat and legible, it shouldn't be an issue at all.

Hey sorry to keep bugging you, but I am assembling the package and need some advise, i am kinda confused.

I am applying I-130, I-485, I-765, I-693, I-864 and I-131

So, this is what I understood from the guide on this forum for how to assemble package.

  • 2 Main Package inside USPS/FedEx Envelope.
  • 1st Main Package is for I-130 and all supported docs.
  • 2nd Main Package has I-485 and supported docs and 4 sub packages inside.

  1. 1 sub package for I-765 and supported docs.
  2. 1 sub package for sealed I-693 form.
  3. 1 sub package for I-864 and supported docs.
  4. 1 sub package for I-131 and supported docs.

Am I doing it right?

That sounds right to me! I had the two separate packages within the one USPS envelope, one for the I-130, and then the other one for the I-485 and other documents (693, 864, 131, 765).

I did my biometrics on Oct. 13, and that's about the last thing that's happened in terms of my file. Hopefully I'll be hearing something about either EAD/AP approval or receive an interview letter within the next few weeks. It's a stressful wait, but I hold out hope that it will be straightforward!

Oh yea...I did read that in your sign..yea I know once you apply, waiting time is the worst thing. I had applied for my H-1B before and it took them about a year to take the decision, and I was rejected. :( So I know waiting is going to be worse and hoping not to get any RFE.

Wow, that must've been tough...having to wait a year for the H1-B then have it be rejected. I was super paranoid that they'd send me a RFE for something (even though I was 99.9% sure I had sent everything, if not more than was needed), but they haven't sent me anything yet. We'll see.

I'd love to know when the interview will be so we can make Christmas plans. Even though we only go away for about 4 days, I don't want to book anything yet just in case they schedule the interview within that time period!

Wow, that must've been tough...having to wait a year for the H1-B then have it be rejected. I was super paranoid that they'd send me a RFE for something (even though I was 99.9% sure I had sent everything, if not more than was needed), but they haven't sent me anything yet. We'll see.

I'd love to know when the interview will be so we can make Christmas plans. Even though we only go away for about 4 days, I don't want to book anything yet just in case they schedule the interview within that time period!

I know right...it feels like we can't plan anything if something is being processed. That's what happened to me when I applied for my H-1B. Me and my wife were planning on going to India this December for the big Indian Wedding but this stupid H-1 rejection screwed everything up and now we are not sure when to go. :crying:

06/03/2011 - got married in Kew Gardens NY court (me, her and her Uncle-Aunt)

10/24/2011 - Mailed out via Next Day USPS

10/25/2011 - Delivered

10/28/2011 - Emails received and can view case status online

10/31/2011 - Checks cashed, and last updated date online

10/31/2011 - Hard copy NOA1 received

11/04/2011 - Biometric notification received for 11/25

11/07/2011 - Walk in Bio completed

11/10/2011 - got RFE for I-485 (specific to I-864, they got confused because I sponsored myself while working and studying on CPT)

11/18/2011 - InfoPass appointment to make sure CPT stuff for RFE is alright (in RFE is said "I was working illegally", scared me to death)

11/30/2011 - Sent RFE response to USCIS (sent explanation about how CPT works and also sent additional I-864 of a GC friend)

12/02/2011 - got email saying RFE response received by USCIS

12/19/2011 - got email saying Interview Notice for 01/20/2012 sent

12/20/2011 - Interview notice for 01/20

12/22/2011 - EAD card production ordered email
