Hi! im back again and good morning to evryone i was here to get some info and help from you guys because i cannot figure out whats wrong with my kids AOS papers why i got an RFE today :o .heres the scenario, i sent their AOS a wk after i sent mine last Feb. but in the amount of $635 each i know it was a wrong amount but tried if i can make it because its awk difference when i sent mine . i got a wrong decision to file my kids AOS after a wk and my husband thought that i am the only one who needs to file for an adjustment. because i am shy to him because of too many expenses from the time he met me up to the time where here but when my husband knew that i never include my kids to my AOS he let me prepare right away the check and i made a wrong amount i thought that would be fine because of 1 wk difference when i filed their AOS. after a month the USCIS returned their papers and indicates as insufficient amount so only my papers had been processed and had my greencard last May i was too busy and needs to add more money just to make the appropriate amount to resend the papers im shy to ask my husband and blame me for doing this and told him since its already returned lets wait for a few months to gather the right amount out of my job.So last month i resend their AOS again i thought it was fine and have their NOA1 and after a wk again they scheduled my kids for biometrics i thought everything is ok and i was surprised this morning i received a mail from USCIS which is RFE for evidence for I-485 .i know i forgot to include the cover letter is that the cause of an RFE? and i also used a new forms because some forms are outdated already and i also include the new/updated vaccination of my kids without consulting the immigration doctor that my kids went too but ill make sure that i did not open the envelope that was given to me last feb. by that immigraion doctor i just add up and clip the updated vaccination of my kids is that a problem or one of the cause of my RFE i also include the ff.

1)birth cert of K2 photocopy

2)passport copy and visa copy

3)I-94

4)photocopy of my greencard

5)NOA2 of my I-485

6)1 copy of I-864-affidavit of support which i sent on my AOS without w2 and tax return

7)medical from immigration doctor/civil surgeon

8)I-485 form for k2

9)I765 for k2

10)picture of k2

these are the copies i sent am i missing anything?

i called USCIS and said i need to respond on the address within 87 days and send the necessary evidence they are asking and have an infopass if needed and get the appointment at probono lawyer if needed and it also indicates on the RFE that they will still process the I-765 even i dont respond on the RFE and by not being comply on the RFE within 87 days case will be denied now i do not know what i need to do and what are the things i should send again hope you can help me about this any comments and suggestion will highly appreciate thanks so much :help:

I'm sorry if I missed something but this is a little hard to understand. Have you only received RFE email or an actual RFE letter? What exactly is RFE letter asking for?

now i double check whats on the bottom of the letter it says Submit evidence that an immigrant visa petition has been filed on your behalf. Such evidence includes a copy of the I-797 Notice of Action on form I-129F(petition for Alien Fiance),Form I-130 (petition for alien relative) or Form I-360(petition for Amerasian,widow(er) or special Immigrant )and /or copy of form I-171 (Notice of approval from the consular office)If you are not filing as the beneficiary of an immigrant visa petition submit documentation in support of your eligibility to become a lawful Permanent Resident OF US so which one should i submit it makes me confused either one or both I-129F/I-797 and I-130?

They're asking for the i-797 approval notice. If you came to the US on a K1 visa, then USCIS needs a copy of the approved NOA2 from the i-129f petition. That is proof of an immigrant visa petition has been filed on your behalf.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

You have that, that is the NOA2. Read that letter very carefully and submit everything they're asking you for.

They're asking for the i-797 approval notice. If you came to the US on a K1 visa, then USCIS needs a copy of the approved NOA2 from the i-129f petition. That is proof of an immigrant visa petition has been filed on your behalf.

ohhh yeah i remember already, i forgot to send the approval notice for my I-129F instead i sent in my approval for my I-485 :lol: just tired maybe btw thanks so much guys for your replies :)

How could you have sent the approval of I-485 with your I-485 application??

vanessa thats for my kids AOS not mine i had my greencard last May i just resend theirs last month

Oooooooooooooohhhh okok. That makes sense then :P
