After reading all the posts and your responses, I feel sorry for you. If you have not moved do so immediately. DV claims are usually taken seriously by Law Enforcement. Keep all your documents and evidence get a divorce attorney and file immediately. Do not be with her in private or without a witness. If needed have law Enforcement stand by while you retrieve your stuff. Better to get what you can and escape now. you will not be deported, believe me USCIS officers have been through divorces themselves. Best of Luck.

Just a quick update, As all know my story here, the last couples of the days she was not home (she did not even say where she is going) so i called and asked about her just to hear some nasty words from her (why do i care) i was just concern about her safety and if she is alright, but i got what i deserved for caring. Anyway in the last 2 days and to avoid any argument with her i took advantage of her being out of the house so i packed my stuff, and they all packed and ready to go, unfortunately i will not receive the keys for my new Condo until Nov 1st (i could of left), so tonight she came back home and she immediately started dragging me into argument which i avoided politely but MAN she is a pain, my short answers and whenever said accuse me with something i said "if that what you think, then thank you". Now she asking to be present the day i am moving... i said you are keeping basically everything why would you care about being present? she said well i do not trust you, that's understandable.

Tonight she was very mean to me and my family, which they have nothing to do with our issue here. she was trying hard very hard to get on my nerves but i was aware of the game and kept super cool. i have seem many movies when couples argue and divorce but this "wife" is one of her kind, is it my kindness? or my personality drives her upset and cray?

Just wanted to update all of you with the latest and newest of my funny unbelievable story :)

I have just finished writing email to my relator to see if she can give me the key before Nov 1st i will hear back from her soon and see if i can move out, because i feel my "wife" is cooking something for me.

If you will look for citizenship you need a clean record, other way there may be delays, protect yourself, paying a hotel now may be less expensive and less stresful than than paying a lawyer latter. Good luck for both of you whaterver you deccide to do.

It will be better for you to move out of that home and this relationship, Before u leave that Home my suggestion is to u to call police and ask them u need their help to get ur stuff from the home without any fights and u can leave that home right infront of police this way police will be there seeing u did not took any of her thing and police will be witness that u both did not had any fight and ur wife can not accused u of domestic violence.

Does ur wife drinks alcohol ? I know that people who use drugs and alcohol they gets Paranoid and start thinking very negative. no matter how good u will be with her, she will be still negative.

p.s You are in USA and ur a free person , u aint a slave , if u want to stay with ur wife or leave her , no one would force u to do something u dont.

after u are in other home make sure to change ur home address with uscis in 10 days.

I say -

don't do it.

Instead, get a friend to do it, but arrange the time with her so there are no surprises.

She has one last chance at a domestic violence charge on you - but it requires YOUR presence.

So if yer not there, it can't be done.

re: getting a sherrif involved.

Sometimes you can HIRE a sherrif when they are off duty for an hourly rate, to wear the uniform and be the protection for you. when hired, he has your interests first. I note this does vary by locale, though.

Hello All,

I have moved out to my new place with no problems, since i did not take much stuff it was a quick run. I have paid every single outstanding balance in all bills and left over 1700$ in the bank for her, but she kept calling me for money and saying it is not enough. My responsibilities as husband ended here as (i know) i am willing to pay support as i stated earlier but is not that supposed to be done once we divorce? i do not mind helping her but she is trying to get every dime i have. therefore i want things to be legal if i am going to give her anything it will has to be by judge order or either we agree about something. Any one has an input about this?

Change your number, any dealing should solely be through an attorney.

also, any bills in both of your names? contact each entity, have your name removed. usually can do this with a phone call.

note - prior bills with both names - if you are doing a ROC casefile (i think you are not) you NEED those joint bills/invoices.

Hello All,

I just wanted to update everyone and let you know what's going on with my "case" I have moved out of the house November 1st. I hired an attorney and filed divorce, my wife (ex wife to be) filed a response as following :

section 6 of form FL-120

respondent requests:

d. nullity of voidable marriage based on

(4) Fraud (fam code, 2210(d))

section 9

she checked the following.

respondent requests:

f. spousal support payable to (respondent)

g. terminate the coutrt's jurisdiction (ability) to award spousal support to petitioner

h. Property to be determined

Do you guys see where this is going? My attorney said she has the rights to claim whatever but she needs to prove this, I have not meet with attorney yet to file financial forms.

what you think of this? and what most important question i should ask the attorney once we meet next week? from immigration side 10 years green card.

It is her words against yours. Both of you will need proof.

As for marriage fraud, how long were you married? If it was fraud whey didn't she file for divorce before?

As for GC, I don't think that they can take it away from you.

If your wife prooves that there was a marriage fraud, you might have a problem when applying for Citizenship.

Confirm with you immigration attorney the above.

Also divorce is done in family court and have nothing to do with immigration. The family court judge will not deal with immigration.

As for spousal support, how she can claim a support from someone she claims is fraud and she wants to get departed?

From my own experience, it is much cheaper to get into agreement with your spouse than to go to family court in front of the judge. Also make sure that you don't pick a lawyer who charges by hour. Get the one who will give you a flat fee for your case. Good Luck
