I received my RFE in the mail today and it has me hopping mad!

My RFE...which says "You submitted form 1-693, Medical Examination and Vaccination Record. However, the civil surgeon certified the exam more than one year before the date the applicant filed the Form I-485." Not wanting to swear on this message board...use your imagination....my medical was completed Aug 2, 2011, they processed my I-485 Oct 4, 2011. Somehow that does not add up to one year for me! So....I got to drive 90 miles each way to Duluth yesterday to get a SSN and go again after my greencard arrives if I want it in my married name, and Monday I get to drive 90 miles each way to Minneapolis for a friggen INFO appointment. Good thing I keep everything related to USCIS!Not to mention I will eventually have to go back to Minneapolis for my biometrics...

I am very cranky now!

This is exactly why i sent a copy of my immigration medical receipt with my AOS package. Sorry you have to deal with this!

That is why I am so angry......I sent the receipt and every other paper I had from the medical. I have a full copy of my application. I even added a signed letter describing I went to the clinic on Aug 2nd and the clinic's address. I am so ticked because this is now delaying my work authorization and travel.

I really think it would of been easier to have Michael come to Canada!

That is why I am so angry......I sent the receipt and every other paper I had from the medical. I have a full copy of my application. I even added a signed letter describing I went to the clinic on Aug 2nd and the clinic's address. I am so ticked because this is now delaying my work authorization and travel.

I really think it would of been easier to have Michael come to Canada!

Okay, I am all calm and collected now, my response is written, evidence resubmitted, off in the mail tomorrow. I have an infor pass appointment booked for November 3rd just incase there is 1) no movement on my case or 2) they do not accept this evidence. If I see my case has been touched I will move the info appointment to a later date or better yet, they will accept my response and send my biometrics appointment!

I don't think they are talking about the medical from Toronto. They mention I-693, did you include it in your packet?

I did with a letter of explanation and quote from thier own code of federal regulations...if you have a medical exam completed by a certified surgeon, then file AOS before a year of the date of your medical exam you are not obligated to complete the I-693 again. It is insane to have to pay yet again to see a surgeon general when the Toronto medical by their designated physican is only 2 months old. I suppose in a week I will see if I defended my case enough. They are not disputing the results of the medical they are suggesting that it is over one year since I had it done.

Ok, I see why they sent you RFE. I remember a few other members who did the same received RFEs for exactly the same thing in the past. You included (blank or only partially filled out) I-693 so they considered it as not properly filled out and signed, that's why they sent you RFE for it. RFE was a generic one, just saying that something was wrong with your I-693 (and NOT that your original medical was more than a year old). You shouldn't have included I-693 at all if all of your vaccines were completed and properly documented on your Toronto medical paperwork.

NO, the RFE said, "You submitted Form 1-693, Medical examination and Vaccination Record. However, the civil surgeon certified the exam more than one year before the date the applicant filed the Form I-485. The medical examination must be conducted by a civil surgeon who has been designated by USCIS." All my paperwork shows the date Aug 2, 2011, I-485 dated Oct 4, 2011. The rest of the notice is generic info on obtaining a civil surgeon and not to submit chest xrays etc. I have read earlier posts from 2007, this is an ongoing problem. So, I responded to this RFE, and if they again request a medical exam I will contact our congressperson. If anything I will use my infor pass appointment to argue for expediting my work/travel documents since this is clearly a mistake on their part.

I am convinced the immigration process tries to make crazy people out of otherwise normal people!

Good Morning, Okay I get what you are saying. Like the other VJ person I was also told by others to submit the form filling out Part 1 along with my evidence of having the medical and also added a supplement dated/signed explaining what I did. So they obviously seen the unsigned I-693 and did not bother looking at the rest of the stuff. Was it clear to others not to send any portion of the I-693 with your medical evidence? In anycase it is done, I am resending everything, no I-693 and will see what happens. What I still do not get is 1) they know you had a medical or you would not be here...maybe needing a few vaccines, which my civil surgeon insisted that I get before he would sign off my exam. 2) my paperwork was clearly labelled and separated, would it really have been that hard to look at??? Oh well, lesson learned and moving forward.

It was clear to me yes. I honestly never saw ANY advice about submitting part 1 (and no other part) and the first I heard of it was the RFE that was quoted above. Very strange.

Hopefully they'll let you slide BUT please be aware that as you were RFE'd, if you do not successfully reply to the RFE they will deny your AOS application and you will have to refile. You can either make an infopass, have a vaccination done, a new medical, or try what you're doing... I think yours is the highest risk.

Hopefully they'll let you slide BUT please be aware that as you were RFE'd, if you do not successfully reply to the RFE they will deny your AOS application and you will have to refile. You can either make an infopass, have a vaccination done, a new medical, or try what you're doing... I think yours is the highest risk.

I am not having any vaccinations done, I know that I am up to date, and have the proof. I sent my RFE response yesterday, I have my congressman's phone number on hand just in case. And I have talked and thought this through enough, I will update everyone when I get a response to my RFE submission. Michael may be coming to Canada lol...
