When can you legally work in the US after POE?

Hi everyone,

When I applied for K1 back in April I was under the impression I could apply for a SSN right after POE and begin to work. However I read somewhere on VJ recently that this is not the case since the EAD takes like 60 days to get and then it is not valid once married? So.. what I'm wondering then is, what seems to be the average timeline once married that you obtain authorization to work? Any insight on this would be greatly appreciated!

you can get a social security card but you can't work,when you apply for adjustment of status, 1-485 permanent resident card, and 1-765 work autherization EAD, then you can work.

You are not legally allowed to work unless you have an EAD or green card.

You have to wait until you have one of thos so marry file AOS and EAD. 3-4 months to get the EAD from filing AOS.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

nope you cannot work until you have an ead, at the moment it is taking around about 60 days or so, so it depends on when you put in the forms, which would be best once applying for AOS as the ead is free with it as well as advance parole. if you applied for ead as soon as you arrived in the country it would only be valid until the end of the 90 days on your i-94 so would have it only for a month so and that would cost $340 so best off waiting until after marriage and applying for aos

You can file for EAD with your AOS. It's free if you do it that way.

My AOS/EAD was abnormally long (due to lack of biometric appt availabilty at my local ASC) so although my EAD was approved about 60ish days after I applied...I did not get an appt for my biometrics until almost 5 months later (you need the biometrics before they can issue your EAD card). When doing an EI claim they go from the date on the card, so I could have got close to 3 months of back payments from EI had I started a basic job search (posting resume on Monster, sending a few applications etc) when I assumed that my EAD would be approved.

I would suggest starting a basic job search around 45-60 days from applying just in case you run into a situation like mine. The $3500 that I could have recieved in back payments from EI would have come in very handy when I finally was able to recieve it!!

EAD times vary from place to place and year to year. For example in 2006 when I applied for mine, I got my EAD in a month. Others have had to wait several months. You will never know until you apply, but you can ask around people in your area since you use the same service center and just see how long it's taken them recently...

In general, i'd say budget 90 days from when you file. It's technically supposed to take 90 days max, but as you can see from this thread, it can get delayed for various reasons.

Enjoy your time off! I'd love to be be forced not to work again!

confused..How can one do an EI claim? was that in canada? the us? very confused..lol sorry its prob obvious..

just strating to think budgeting for when i can start working after i move..

There is a whole Canuck EI thread pinned to the top of the forum. You can claim EI through Canada after you move to be with your spouse. :)
