Info about ROC after divorce

Ive posted a long time ago about my situation and finally decided to just divorce my husband since he hasnt changed and harrasment continue. can anybody tells me what should i do after i file a divorce? tentatively, the 90 day ROC window will fall feb 2013. i keep on reading this waiver thing on some forum so i wanna know if im eligiblle. thanks you

Once the divorce is final you can petition for removal of conditions. See the form I-751 instructions.

If you look on the profile you can see clearly what the issue the OP has. Her husband is not faithful and sleeps with other women. Also threatens to send her back to her country.

Anyways to the OP, once the divorce is final you don't have to wait till the 90 days you can file with the waiver right away. As Anh Map says the information is in the instruction page for the forms http://www.uscis.gov/files/form/i-751instr.pdf on page 2 it explains how to do things.

Shezhen, seriously youre not helping.anyways yeah. I know,he will continue doing his stupid things and wont cooperate with me and givr me a,hard time with my green card so I wont have a normal life, like what he always say when hes mad at me. I read tax is important so im not expecting him to file it woth nr so at least if im divorced, I can just does it myself with no worrying

Although I think therea interview, compared to when couple stayed married for 2yrs.

I am dumb but can anyone help think what decision I,should do. Juat keep my mouth shut and wait til tax maybe he will file it with me or divorce it now and does the waiver. Hes smart and I know if I decide not to get back with him, he will screw me up.

if you are getting close to that 90 day window,

you can go ahead and file on your own, as IF you were already divorced,

and mention in some cover letter that you are filing for divorce and you'll have a divorce decree sometime in the next few months.

otherwise you might get dinged for filing past the window.

expect an rfe for the divorce decree..

you CAN file for divorce without an attorney, for the initial filing - ask the clerk of the court for the templates they utilize.
