Tourist Visa needed for K-1?

Hi all. I recall reading something about the tourist visa in my fiance's passport needing at least one year of eligibility. Does anyone know if there is a rule like in terms of the K-1? I just looked and see that the tourist visa will expire December 2012 and we will not have the K-1 until February or March 2012 probably(leaving only 9 months or so on the tourist visa).

I don't think it makes sense for him to try to get a new tourist visa for 2013 since by then, we should be married and working on AOS.

i could be wrong but i would think that once your fiance gets the K-1 the tourist visa will be no use anyway

No, I was also confused with that as well, my fiancee asked various sources and the answer was that once you get the k-1 visa the tourist visa will be invalid from the date you arrive at the POE.

Okay, great. But they need one year minimum left on the Brazilian passport itself when they go for the interview and visa at the embassy/consulate, right?

I thought it was only 6 months, but you should be able to find the info on the consulate website.

The passport is 6 months but for some it is more of a hassle to renew here or every back home if you are only on a short trip. It might make more sense to renew shortly before your interview date. The other passport requirement is that it is a machine readable type.

This will not be over quickly. You will not enjoy this.

The B-2 visa will still be valid - even if the K-1 is granted. (as long as your not pass it's expiration date of the B-2)

(Remember - the K-1 is valid for a one shot entry).

Unless the B-2 visa is revoked or cancelled, it is still valid. Getting a K-1 visa does not, in itself, revoke this previous visa.

However, if you are planning on getting a green card, I would not get the B-2 renewed.

Umit still has her B-2 visa in her passport, and it's valid till 2015.

I would recommend you renew your passport while in your home country - helps in the future.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

He doesn't need a tourist visa. His passport must me valid for at least 8 months when he's interviewed in Rio.
