My mother is a LPR and she is planning to file for my two brother, ages 17 and 23. the 23 is married. is she looking at about 5 years for their petition to be completed?

Mar-10-2009 Transfered to CSC

May-27-2009 Green Card approved

sorry, unfortunatly she cannot file for your older brother. residents cannot file for married children. only for unmarried.

if she becomes a USC then she can file for him, and it takes many more years depending on which country he is from.

she can file for the 17 year old brother and again it will take 2 to 4 years depending on which country he is from.

Your LPR mother can file for her unmarried 17 years old son. It currently takes about 3 years for an LPR parent to petition for an unmarried child under age 21.

Only a US citizen can file for a married child. An LPR can not file for a married child.

WOW reading is essential i just read through the I-130 and realized she can't file for the 23 year old.

we just told you, LPR cannot file for married children, only unmarried. She has to become a USC to file for your married brother, and the waiting period as a married child of a USC is more than 8 years, so he has a very long wait until your mother is a USC and files for him.

for now, she can only file for the 17 year old, and it will take more than 2 years currently.

Depending on how long does your mother have to wait to become a citizen, the fastest way for your brother to come would be for you to file the petition for him.
