Hello all,

I'm new and I have a question about my VISA.

My husband is in the US Army and he'll PCS in August to North Carolina. He's stationed in Germany at the moment

and I'm German.

Which Visa do we have to apply for?

Which is faster DCF or K3?

What are the benefits and what is actually the difference?

Hello :) I think I know you from GS, if that is you, atleast the details besides the husband are the same ;)

If you get married while he's still in Germany then you guys could apply for the DCF ( CR-1/IR-1) which is the immigration visa, K-3 is non-immigration and then you'd have to do AOS so DCF would be the best option I think.

June 22, 2013 I traveled to the USA with the plan of returning to the UK, spoke to a Immigration lawyer and he told me to change my status and go the AOS route.
Since 2014 I am a permanent resident.

You applied for DCF, too? Can you explain me the difference or the benefits?

I just read that it's faster than K3? But is there more to fill in?

I have I-130 and G-325 A is that all?

Well, it might be cheaper because you don't have to do the AOS if you do DCF. And why would you do the K-3 when your future husband is still in Germany when you have the opportunity to start the DCF.

We did it because why would I want to be separated by my husband when we have the chance to do the DCF while we have the opportunity and get lucky so we both can leave England where we're at now.

For the K-3 I believe the petitioner has to be in the US to start that, not sure though but pretty much everyone does the DCF when they have the chance.

But first of, to do so, you gotta be married.

Oh and yes, it's the I-130 and the G-325A for the petition and the G-1145 for the E-Notification of Application/Petition Acceptance with certain other documents that are required.

We're going to marry in December this year...

And I only fill the I-130 and G-325A for a DCF or more?

Do we have to live together to apply for DCF?

Because he'll live in Parsberg and I'll stay in my hometown... The first time we'll live together will be in the US in August 2012...

Okay, then you could do the DCF once you are married. Your future husband has to have lived atleast 6 months in Germany then to be able to apply for the DCF.

He will have to fill out the I-130 as the petitioner and then you fill out a G-325A and he will have to fill the G-325A and you guys will have to fill out the G-1145 for the E-Notification of Application/Petition Acceptance. He will need a proof of citizenship and a few documents more but this you might find out of the US embassy in Germany, so take a look at their website.

Hmmm, not sure if it would work then still but you could still apply for the CR-1 in this case.

I-864 is the Affidavit of Support and yes, he will need that too but not for the petition.

And yes, for the DCF you would mail or bring what you posted above to the Embassy, with some other documents like the fee of $420, proof of recidence, proof of citizenship, marriage certificate and offical translations, divorce degrees. This is atleast what it says on the checklist for the I-130 of the US Embassy in London.

Maybe someone else can help on the question if DCF would still work when you get married in December and before he leaves in January because I am not sure.

Actually, the process has changed. He has to file with USCIS that is located in Frankfurt consulate - http://germany.usemb...gov/visa/uscis/

They are the ones now accepting DCF, not the consulate. Looks like he needs to make an infopass to schedule an appointment.

Yes, you will need I-864 but only at the time of interview for your immigrant visa, not at the time he submits I-130. If husband is deployed at the time (active duty) he only needs to prove 100% of poverty line, if not, 125% applies. Make sure to bring his LES and tax transcripts.
