Hi to all,

I am in some sort of very custom situation.

Me and my wife have since last Year a GC. So far so good but we are still stunding in Germany. I am goinig to need somme around one more year to graduate.

for the purpose of not loosing our CG we were last year and this year for two weeks in USA. Now we are in Germany again. I wonder should we apply for I-131.

Actually I wanted to send the application form from Germany and to travel for the Biometrics appointment in USA.

Would we have enough time after we receive the confirmation letter to do so?

Should I expect some troubles for not being in USA sending the application form?

The instructions state you have to be physically present in the US when you file the 131 for re-entry - and you if you leave prior to to the collection of the biometrics, the permit can be denied.

So your best bet is to come back to the US, file for the 131, wait/do the biometrics, then have the 131 sent to your home country embassy/consulate.

In most cases, biometrics are given in 2-3 weeks from filing, however, some people have reported success by just showing up to do them without an appointment (as long as you have the NOA)

You are playing a dangerous game staying outside the US with a green card without this permit, even though you come back for two weeks, there are reports of people getting in trouble with CBP doing this. Their not stupid, they can see your history and figure out what your doing.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I'd just like to clarify that this is true if you send in i-131 application and then leave the US and do NOT complete biometrics you will most likely have your REP application denied.

However, my wife has recent successful experience:

  1. applying for a REP when in US
  2. departing US
  3. returning to US for biometrics (walk-in)

This obviously required 2 round-trip flights to the US.
