divorce and remarrying nothing filed ever

So what would you guys think: how many years you would think help to wait to marry? I don't want to take a risk of getting denied and separated for life. I'm ready to wait long time only end up being with him.

The lawyer said there are guys who actually remarried the next day and there was everything ok for them. But it sounds so unrealistic to me. And I'm also thinking that waiting would be good. Please, give me your opinion as if you were an IO, what time should elapse between the marriages that would be safer to go.

IMO you need to get your divorced/current status solved before thinking of how it will affect you and your new boyfriend.

In any case you should make sure you keep as much evidence as possible of your new relationship especially length and genuineness. It won't matter if you wait 5 years to marry him if you can't prove you've been together that long. Open a bank account together, make him add you on his credit cards and lease. Keep every letter that has his address on it. Make sure you take pictures of holidays with the family, etc. I know this are silly ways to "prove" you are in love, but it seems that's what the USCIS cares most about, so be prepared.

Hello. Haven't been here for a while. Want to update my situation, which is partly resolved but complicated more from other side.

I got divorced from my ex in December and now married since April. We didn't file anything yet.

I said earlier that I had my SSN and couple of other docs lost or stolen. I still don't know what exactly happen. But I have my suspicions.

I recently got the annual credit report and found 2 accounts under my name that were in collection and they told me the address of my ex. They were opened around a week after I left the state where he lives. I asked him about it and he admitted he opened them as he is saying I needed internet and wanted a phone and that even I left he was hoping I would come back...

I contacted the credit reporting agencies and creditors and told them about that.

After that I also called IRS and asked them about the tax return that was filed for 2010 that I've never even seen and they told me they had a 2011 also that was filed jointly after the divorce in December. I never signed any returns wit him.

I called his mother and told that to her, she said that she knows he lies a lot. And even if he did so, she cannot control him anyhow, cause he lies to her too.

When I spoke to him and asked why is he doing all that, he said that I should be happy that's all he did, and he could cause a lot more damages to me if HE REALLY WANTED, like getting money from banks and credit cards and that as I have been out-of-status for a long time, I "would better not go the route of opening this matter up".

I don't know what to at this point. I'm intending to do whatever it takes but do the right thing. Just don't know what to begin with.

He also said that if I get married again, I might have problems.

I'm afraid he would do anything now knowing my SSN and can also go to USCIS and say that I married him for a Green Card, though I never applied for it.

First thing you need to do is to file a police report against your ex for opening fraudulent accounts.

Second, call all 3 credit agencies and dispute those accounts. Also ask them to put a freeze on your account so that your ex can not use your information to open more accounts.

Third, file your tax return as single if you have not already done so.

I'm glad you're divorced since it seems that's what you wanted.

Start getting your lost documents back (I'm doing the same since my Ex burnt all my documents collected over 20 years), you can get them back.

Don't live under threat or duress, it's not worth it.

I'll get married and file the papers and hang on to see what's going to happen.

Your Ex has already did a lot of fraudulent stuff (he can indeed close the joint bank account) don't let him keep blackmailing you.

One thing, do your best to make this relationship work (don't let your past issues erode this one).

I asked IRS to send me transcripts as he told me somebody prepared them for him and he relied on them, but I don't believe him anymore. I'm totally unaware of tax filing, since I'm not working. I did a couple of translations and tried to fill out on Turbo Tax for 2010 but it said I don't have enough income for filing...

The only employment I had here was back in 2005 on my Work and Travel 4 months and sponsoring company was taking care of it and I had my refund in Russia.

So I cannot even file my sole return since I don't have anything to declare. Should I only let them know that he couldn't file joint and send the IRS the divorce decree?

If there's an office nearby I would attend in person with a copy of your divorce decree and several forms of ID that bear your signature. It's likely he faked your signature and they'll wanna know that. I see an audit in his future! before you start down that path though follow the other advice regarding protecting your SSN and credit rating. The SSA WILL sometimes issue a new SSN depending on whether someone's identity has been compromised. i don't know what's involved in it but it might not hurt for you to go and speak to someone about it and telling them that your ex keeps opening accounts in your name, filing taxes and forging your signature and other criminal things. They might permit a new SSN.

If the bank is a large (multi-state) bank like Chase, Bank of America, etc then you should be able to go into the local branch and get your account information. He can't remove you from the account or close it completely without your signature (unless he commits a fraudulent act such as forging your signature

My husband closed our Chase account by himself earlier this year while I was super busy at work.

It's an older thread, but the OP opened it back up a few days ago and is looking for responses to her current situation. I would definitely notify the credit agencies, file a report with the police, and file AOS paperwork as soon as possible.
