Hello. My situation is like this: I'm currently in the process of divorce, we were married April 2010 but weren't living together right after the marriage for a couple months. I went back to Florida cz I was working there for a couple of months. Went back to NJ in September. In a while we started to have difficulties and at the end of October I left back to FL and decided to divorce, but he also kept telling me to come back. He sent me my books and clothes by mail. In April I filed for divorce and he got a lawyer and filed a counterclaim also. So we are now in the divorce for more than half a year already. Working on Property Settlement Agreement, though there's nothing to divide. He doesn't speak to me, only recently about signing the agreement.

Some details: When i was in NJ with him, he checked my phone when I didn't know and sent a couple of messages to my friends. We talked about that and he promised not to do so. Then in a week I woke up in the morning and he was in the bathroom, I found his pants on the floor, got them to laundry and found my phone there again (i put it under the pillow in the night). So later when I left to FL after all that, I realized that the marriage certificate, credit cards and check book and my car title went missing together with my SSN card. I don't know exactly, but I suspect he could take it. As they disappeared after my decision to leave him.

He was telling me rude things when I left and was saying he'd "get rid of me" soon. I don't even know what to think now.

I'm currently in a relationship and he is the most caring person I've ever met. He knows my situation and wants to marry me once I'm over with it. I'm really worried that my soon-to-be ex can do something to harm me or maybe try get me out of here by telling USCIS that I married him just to stay here, though he never filed any paperwork on my behalf. Can he still do anything to me so I would never be with anyone here after divorce?

You need to sort out your problems with your Currant/Future EX and finalize something. Alot a Drama.

If threats are made then call Authorities and ask for a Restaining Order that is in your favor.

You have what is called "Leftover Baggage" and is not fair to what you think is next Husband. You have not completed your divorce and still dealing with it. I wish you luck.

But, your as ready for a new relationship as a frozen Oscar Meyer Weiner in a frozen bun at the County Fair.

I'm afraid now he can say whatever he wants and could tell USCIS that I married him for Green Card to screw up my future marriage and if I ever apply with my boyfriend in future. My ex never filed anything for me. But I guess they can still listen to him.

OK... TO YOUR KNOWLEDGE. Have You Broken any USCIS Rules ? And if so. What. You know other Members will help but you need to be accurate.

I'm out of status after F-1 denial Nov 2009. I was going to leave then in the beginning of 2010 not to trigger a bar. In March he said he was serious about me and proposed. So I stayed here. And now I don't have any status, waiting for divorce after a year of our separation.

I'm in love with my boyfriend, he is really taking care of me after I was crashed last year after all that.

Only recently I found this forum and started really thinking about all that and my docs disappearance. And I thought what if all of this was on purpose and he's trying to get me deported or accusing me. Don't even know what to think.

I only have one marriage now. Will marry my boyfriend after, but we will wait of course, though I'm actually living with him now. What time is it better to wait so they would not think that I remarried to get residence? How long would it be better to wait at least?

And if get more evidence, would I need to start getting it fight after divorce, 'cause there's anyway the fact that I'm with him when the divorce is not finalized yet.

You should finish the divorce now. The marriage didn't work out - it happens.

Get married as soon as the divorce is final.

The next day - put in the paperwork to get adjusted. Your currently out of status, and can suffer ICE problems if found in this condition.

Since you were married right after the F-1 denial, that would raise a red flag. Another red flag is getting married again. Be prepared to prove that these marriages were for love and not immigration purposes.

Another red flag is how your working now (and after the F-1 denial) - be prepared to show evidence that you are legal.

One more possible red flag is your leaving after the first marriage to go back to work in FL.

Question - what visa did you enter the US on originally? Why was the F-1 denied? Are you working legally?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

If she was denied an F-1 while in the US might that have triggered a removal order?

Or she may of been given 30 days to leave - depending on the initial visa used to enter.

I was in FL before our marriage and as we didn't plan it from long ago, I had all my stuff still in FL and a car. Went back to get it. Was thinking about driving it there but couldn't do it alone and he was then going to fly here to drive it together. Then we decided just to sell it. My work during that time was a couple of translations done and I was helping with English to one of the girls I know for tests to college. But that was it.

I got a ticket then in August for my Driver's License n FL, 'cauze it was from Maryland issued when I lived there in 2008. (I came as a J-1 living in a family). He told me to come to NJ and leave the car and later we can get it.

So I went back to NJ at the end of August and the car was just left in FL at my friends'. The ticket was then dismissed, as I was living in NJ.

So I only lived there for two months, after which I left and didn't want to be with him anymore. Though i filed for divorce only in April, 'cauze I didn't have any money and was saving some mostly depending on my mom's support.

I'm currently not working, though I had a couple of translations done for student friends. And now my current boyfriend supporting me together with my mom help sometimes.

I'm so really tired with that all situation hanging and me having no income by myself. And I'd be happy to leave if not my boyfriend. I know because of the bar I will not be with him if I leave.

My F-1 was denied because of more than 30 days (around 2 months) between statuses.

I checked my status case for F-1 application. It's just saying about the decision and that's all. Does it mean that there can be a removal order? Yes, I received a letter then stating that I had to leave immediately or I would start accruing unlawful presence.

That doesn't sound like a removal order, just the standard - "get out before you get out of status days".

Was your J-1 subject to a two-year Foreign Residency Requirement?

If not - then get the divorce and re-marry - file the AOS and get evidence ready as explained in my previous post.
