CONFUSED IS SPONSOR NEEDED

Well from 2008-2010 I dont meet the income requirement at all because of real estate property that I claim on my taxes, I claim a loss, but my gross pay before the allowable loss is double the poverty guide line for 2 people. but for 2011 I will meet it and exceed it I recently got a raise and my income will be just right. Also my new monthly salary going into next year will be above the poverty guidelines so should I be worried? I have been working for the same company for 7+yrs and 8yrs in April 2012. So there is stability in my work. I dont really have anybody that can help or at least I havent found anybody yet. my employer said that he will give me any letter I need and my job is secure! I still havent filed my I-130 yet so I have time to figure this stuff out. thats why I'm counting on 2011 taxes as I will be sending in my I-130 in mid December as I will be getting married on Nov. 25, 2011. thanks in advance for all the advice.

Unfortunately the only way for you to know if you need a sponsor is if the NVC tells you that you need one. I am in a similar situation right now. I decided to go ahead and get a co-sponsor since I had one available. However, since you will be filing your AOS in 2012 you will have 1 of the 3 previous years of income listed above poverty guidlines. This will help your case a lot. I highly recomend getting a letter of employment (make sure it is on company letterhead). This is an example of the one I used:

Re: Employment verification for <petitioner's full name>

To Whom It May Concern:

This letter is to confirm that <petitioner's full name> has been employed full-time with us since <employment start date>. <petitioner's full name> is currently working with us as <petitioner's role/title>, and is an employee in good standing. His/Her annual salary is $00,000.00 as of fiscal year <current year>.

Please feel free to contact us if your office should require further information.

I would also include an explanation of why your income doesn't appear as it actually was due to the property you calim. Any documentation you have to clarify that might help you greatly and no co-sponsor might be needed. You have plenty of time ahead you though to get it all straightened out, in the mean time try to get an option or two for a co-sponsor just in case.

I have a lot of real estate too, so I get what you are saying. Send your w2s, current paystubs letter of employment along with the tax transc ripts. They will hopefully understand that real estate losses and depreciation are not true cash income loss. I always depreciate as much as possible, too, but fortunately its never enough to push me too low.
