I am in a great relationship with a Chinese woman I met almost 2yrs ago. We met while she was here in USA (NY) on B1/B2 visa. I have visited her in her home town of Beijing and met her family in northern China during my second visit. She has been back and forth between China and USA several times during our relationship. In fact we have been living together,(except for the few short week or two she has been in CHINA), for about the past 18 months.

She is still in NY on a B1/B2 Visa (entry date 6/17/11 and her I94 expires 12/16/11).

We married on 10/8/11 in NY and based on some personal research and information obtained from USCIS website and other sources I believe we are able to file I-130 and I-485 concurrently.

I am prepared to file I-864 and I-765 when needed.

Is this something we can handle on our own or should we enlist the assistance of an attorney or visa service?

Any ideas or suggestions would be very helpful.

Oct 25 2012 - Sent AOS/IV Package

Oct 29 2012 - Pkg Delivered
Dec 24 2012 - Case Complete

May 17 2013 - Interview-Approved

July 19 2013 - Enter the USA

Thanks very much, I have already read through that information and downloaded and filled out most forms. I am curious about a "Police clearance" and its necessity. Also if anyone has been through this procedure recently with a spouse who is from China.

What about if the visa expires during the processing of paperwork, any issues with that?

re: police clearance certificate and her birth certificate.

She's got this thing called a 'hukuo book'

inside of it are listed her family members.

ANYONE of them, listed in the book,

can go to the big PSB office and get the PCC done,

can also go to the 'other' office and get the birth certificate

and then

go to a notarial translation office, and have it translated into English.

Then the two newly generated 'white books' - that relative will need to ship them to her, via fast boat (DHL is nice, Fedex also can)

Expect about another 400 in fees to pay (USD), so prep some monies for that relative in the hukuo book.
