Hi Guys I filled out i-485, Application to register permanent residence or Adjust Status.

But there is another I-485 adjustment of status UNDER SECTION 245(i)? Do i still need to fill this out because if i do , then i am having trouble on Part 2 and Part 3.

you fill out both, the i485 and i485A and send them in the adjustment of status packet

yes you need to file the i485A and pay the $1000 fine. every person over 14 who is adjusting under the 245i has to fill it out.

what seems to be the problem, what are you having trouble on? the i485 or the i485A?

A. I am the beneficiary of a visa petition filed on or before January 14, 1998.

B. I am the beneficiary of a visa petition filed on or after January 15, 1998, and on or before April 30, 2001.

C. I am the beneficiary of an application for a labor certification filed on or before January 14, 1998.

D. I am the beneficiary of an application for a labor certification filed on or after January 15, 1998, and on or before April 30, 2001.

I Came to us october 22, 2001

2.And I fall into one or more of these categories: (Check all that apply to you.)

a.I entered the United States as an alien crewman;

b.I have accepted employment without authorization

c.I am in unlawful immigration status because I entered the United States without inspection or I remained in the United

States past the expiration of the period of my lawful admission;

d.I have failed (except through no fault of my own or for technical reasons) to maintain, continuously, lawful status;

e.I was admitted to the United States in transit without a visa;

f.I was admitted as a nonimmigrant visitor without a visa;

g.T was admitted to the United States as a nonimmigrant in the S classification; or

h.I am seeking employment-based adjustment of status and am not in lawful nonimmigrant status.

a. You were granted asylum in the United States;

b.You have continuously resided in the United States since January 1, 1972;

Immigrant, and are applying for adjustment as a special immigrant juvenile court dependent or a special immigrant who has

you're having problems because you aren't covered under the 245i law, that's why. you can't adjust status in the US. to be covered under the 245i, you should have entered before or by December 21st 2000, and the petition be filed before or on April 30th, 2001, you entered in October, 2001. you should have waited in your country to get the visa.

I just found another thread that you had written, you don't need the i485A, only the normal i485. your USC spouse is filing for you and you entered legally on a B2 visa, overstay is forgiven.

the 245i law is for petitions filed by April 30th, 2001, such as siblings petitions that take 10 years or more of waiting, or parents filing for married or unmarried children. or if you had entered ilegally, EWI, then for you to adjust status in the US, there must have been a petition filed on your behalf by April 30th, 2001.

you don't need to file this form.

Im From Mongolia, i came to U.S in October 2001 with B2 visa. And i overstayed ,

My husband is us citizen .

that's what I found, you don't need to file this form, as stated before, overstay is forgiven. just the normal i485.
