Hello. I would like to ask if we are going to file DCF, is it alright if he was not working for 2 years when he was in the states before going here in the Philippines? Do we still qualified for the DCF? what do we need to do?

DCF is for legal residents of the spouses country. In this case the Philippines.

He has to be a legal resident of the Philippines. he will need to prove he can support you 125% of the poverty guideline and supply tax transcripts. If he does not have them he will need to provide a letter stating why he did not have to file taxes. Then he needs to get a co-sponsor because he will not meet 125% of the poverty guideline.

Thanks for the reply. Yes, we are going to apply for his permanent resident visa.

I want to assure, on our case, all we have to do is to get co-sponsor? So you mean, there would no problem though he did not be able to file taxes because of not working for 2 years.
