Hi everyone: I'm cuban. I came to USA with a Fiance Visa but everything became a Hell once I was here. Persecution problems with my family in Cuba once I left Cuba, they even were put on jail under investigation. Economics problems with my fiance,,,,she lost her job a short period after I arrived and others personal problem came out in a short time. These situations made our relationship stronger than ever, but we couldn't get married in the 90 days period. After 7 months all seems to go well around us, and we think it's the correct time for the weeding. I have read that i can no longer apply for the AOS, but I can fill the I 130 and I 485. How long does this process take and if there are some problems for applying for the green card?

You will file for AoS not based on the 129F, but because after the wedding you have become the immediate relative of a U.S. citizen, your wife. You need to familiarize yourself with the AoS process, and submit all forms concurrently, together with a check for $1,490 and a new medical from a civil surgeon.

The process will take anywhere from 3 to 5 months, longer only in some unusual circumstances.

Alejo, check with an attorney. You may be able to apply for adjustment of status under the Cuban Adjustment Act based of presence in the U.S. for a year and a day. So in other words you marry your fiance and apply for AOS under CAA then the problems you have to overcome because you didn't marry in the 90 days will not be present. Check with an attorney first, though.

9/6/2011 - NVC Havana case number assigned

9/16/2011 - NVC forwarded case to Havana

9/19/2011 - NVC generated informational letter to me

9/23/2011 - Received letter from NVC via snail mail

10/6/2011 - Packet received by US Interest Section in Havana

10/18/2011 - Amel received telegram advising him when to pick up packet

12/05/2011 - Amel had blood work and x-rays done in preparation for medical examination

12/12/2011 - Amel picked up packet of forms at the USINT in Havana.

01/10/2012 - Amel had his medical exam today.

03/01/2012 - Interview: APPROVED!

03/20/2012 - Visa received.

3/23/2012 - Carta blanca, etc. requested

Check with an attorney first, though.

You do not need an attorney. You need an I-130 in addition to the I-485 and the extra fee for that.

If you want to waste money on an attorney rather than read the directions, that is your decision.

DO NOT LEAVE THE COUNTRY until the green card is IN YOUR HAND
