I-864 for parents, Can parents sponsor themselves financially?

HI VJ surfers,

My brother in law wants to fill out 2 separate form I-130 for both parets. His annual salary doesn't let him to sponsor them. so eventhough he will fill out form I-864,he will rely on his parents assets.

He just wants to make sure tha

1-this is possible, and if each of them should show separately that he/she has enough assets.

2-if my brother in law wants to fill out a form I-130 for his sibling, is it good to do that at the SAME TIME as parents?

3-Considereng the above situation (sibling),it takes between 11 to 16 years to have his sibling here in the states, at that time hopefully he can make enough money to be able to SPONSOR his sibling. so you think that my brother-in-law doesn't need to show enough salary for his siblings AT THIS TIME. Am i right?

If he doesn't make enough, he will need a joint sponsor for each one, as the petitions are filed separatly. He won't be sending the affidavit of support for his siblings right now.

He need to qualify on his own. There is no such thing as self-sponsoring. If he can't qualify he will need a co-sponsor.

It's a lot easier to use the assets of the intending immigrant when the I-864 is being submitted in conjunction with an I-485 for adjustment of status because, in those cases, the assets are usually already in the US. It's difficult when the assets are outside the US, especially if the assets are immoveable like real estate, since it's hard to convince a consular officer that those assets will be available to support the immigrant. There's a pretty good chance they'll ask for a joint sponsor.

The I-864 isn't submitted until the petition reaches the NVC. For a family preference visa, that doesn't happen until the priority date is current.

Your brother-in-law can submit the petition anytime. His parents may want to also submit petitions for the sibling after they arrive in the US and get their green cards. Depending on how old the sibling is, and what country they're from, the priority date from the parent's petition may be current before the priority date from the brother-in-law's petition.
