Fiancé interview was on 10/17/11. Fiancé RECIEVE a 221g asking for more documents BC/CENOMAR/NBI clearance for his previous last name which was ammended on his current BC from NSO. Anyway I was wondering if the I- 129F petition expiration date on 12/7/11 still stands? Our I-129F petition was approve on 8/8/11.

since he already had his interview, hes allowed up to 30days to submit the required additional docs. might be even longer. he just have to let them know if so. for some that had prob for affidavit of support & financial stability of their fiance, they were given up to a year to have their proof so im guessing depending on how hard for him to acquire the required documents he will be allowed up that time to gather & submit them. he just have to keep intouch and make sure about it.

I've never heard about the 30-day rule before. It's my understanding that the Embassy routinely will keep active cases open. In your case, your beneficiary has demonstrated to the Embassy that you have an open and ongoing case because the beneficiary had his interview.

If you are worried about keeping your case active, all you need to do is to stay in contact with the Embassy and let them know that you are actively working on your case.

We're trying to see if there is a existing NSO BC regarding his birth last name. All I know is his current BC from NSO is labled delay registration.

If there's no existing record of his previous last name, I suggest to ask a letter/affidavit from NSO explaining why and to certify that it's same person. I remember my aunt done this before. Goodluck!
