We are having trouble with the finances and paying for the paperwork and finding a co-sponsor. Is it possible to have an extension on our application to give us more time? Apparently the application is at the embassy now.

Well thats good, I just have a question though. Oua NOA2 says that the approval notice is valid from 9/2/11 to 1/1/12. Doesn't that mean the application expires as of 1/1/12?

E-Mail for the Extention. You have time. A bove post indicated up to one year. I have been told this is true but write before the expiration of each 4 month period. I'm unsure. They have 7 to 10 days to respond but remember, they will nt really tell you in the e-mail reply. You must Call. Also, I heard that the Existing Petition must expire before the Consulate will grant the extension. SHEEE'S

I had to email the consulate because when I called they were no help at all. They said they would extend it for four months. So help me make sure I understand. We already extended it four months. We are allowed to extend two more times, if needed, up to a total of 12 months. Am I following you correctly?

I am adding onto this thread since the VJ thread police will just combine it anyway. Our application is at the embassy now so I emailed the embassy and they responded with the folling excerpt:

"An approved fiancée petition is originally valid for four months from the date of approval. However, it may be revalidated by a consular officer for an additional four months, during the applicant’s interview during the applicant’s visa interview. This revalidation is routine as long as the petitioner and beneficiary remain legally free to marry and plan to do so within 90 days from the date of the alien’s admission into the U.S. in K1 status. We have noted your request in our system."

Does this mean that she has to go to the interview in order to get the application extended?

No. As long as you're communicating with the consulate that you intend to proceed then they'll renew the validity of the petition approval as a routine matter. You don't have to go to the consulate to get the validity of the petition approval extended, and it's their policy not to allow the petition to automatically expire unless they are getting no communication from the beneficiary or petitioner. They can renew in four month increments up to one year. After that, they must consider the petition abandoned, and return it to USCIS.
