I never thought I'd be asking this, but it has been nearly 7 months since my wife filed for AOS and she is still without her GC. I know that the EAD she has can be renewed based upon her original AOS filing. The website says it take 3 months to process an EAD but I have ZERO faith in what USCIS says since the GC says it is taking only 4 months as of now...

The last thing I want is for for EAD to expire which would make her lose her DL and all the headaches that go along with that (among other things, including being forced out of any job she may be working by then). Does anyone know what is the earliest you can apply for an EAD renewal? I don't trust that USCIS will get it done within its own stated timeframe if we wait until the 9 month mark... Would she need to apply for AP again as well since it is part of the dual purpose card?

And, sorry if this is the wrong place, but this EAD is based upon a pending AOS so I asked it here.

Apply about 120 days before the original EAD expires.

Thanks... that's still a couple months out. Hopefully, the GC will be here by then and there will be no reason to do so but at this rate, who knows???

I'm fairly certain (99.9%) sure that it is free to renew with a copy of the original I-485 Receipt Notice. I also just looked at her EAD card and since it also says "Serves as I-512 Advance Parole" , I'm assuming her AP permission also goes away on the expiration date and will need to be renewed as well..

Have you looked into why the AOS is taking so long? Considered getting your congressman involved?

Yeah, we actually downloaded the forms 2 weeks ago to fill them out but decided to wait for a response from USCIS (which came today) and was nothing more than "Your case is currently under review. You will be notified by mail once additional action has been taken in your case." In other words, a cut and paste, meaningless answer.

Even so, I have little faith in my elected representative to be of any assistance in her case (or anyone else's immigration case, for that matter, based on his stated immigration stance) so we want to try to be as proactive as possible given the very secretive and less than helpful culture at USCIS.

They are often quite helpful. While I've never seen them actually SAY anything, I have seen most in most cases USCIS suddenly just updates the case.
