Timeline

Hello there,

I am on a K1 visa, waiting approval of my AoS. I am currently doing some applications for interviews and one of the questions is this:

Are you a US Citizen or National, Permanent Resident, Refugee, asylee, Application for Legalization or Amnesty? (Yes/No)

I am wondering if AOS is considered an application for legalization.

K1 Visa Timeline

01-27-2011: NOA1!

02-22-2011: NOA2!

03-14-2011: Packet 3 Filled Out. Delayed Interview until closer to POE, August.

08-09-2011: Interview at 10am!

08-19-2011: POE

08-21-2011: Married

AOS

08-25-2011: Sent AOS Packet with EAD & AP

08-29-2011: NOA1 for AOS, EAD and AP

09-29-2011: Biometrics Appointment

After you do AOS, you are a legal Permanent Resident--you are NOT a refugee nor asylee, nor did you get amnesty (the last implies you entered illegally without filing any paperworks).

Till you have EAD in hand, you are in-limbo (but are still legal).

2005/11/07 I-129F approved, forwarded to NVC--to Chennai Consulate 2005/11/14

2005/12/02 Packet-3 received from Chennai

2005/12/21 Visa Interview Date

2006/04/04 Pras' entry into US at DTW

2006/04/15 Church Wedding at Novi (Detroit suburb), MI

2006/05/01 AOS Packet (I-485/I-131/I-765) filed at Chicago

2006/08/23 AP and EAD approved. Two down, 1.5 to go

2006/10/13 Pras' I-485 interview--APPROVED!

2006/10/27 Pras' conditional GC arrives -- .5 to go (2 yrs to Conditions Removal)

2008/07/21 I-751 (conditions removal) filed

2008/08/22 I-751 biometrics completed

2009/06/18 I-751 approved

2009/07/03 10-year GC received; last 0.5 done!

2009/07/23 Pras files N-400

2009/11/16 My 46TH birthday, Pras N-400 approved

2010/03/18 Pras' swear-in

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

It's a way to rephrase the question "are you authorized to work in the United States of are you in the process of getting authorization?"

The answer is YES. I would consider having filed for AoS exactly that.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Application for Legalization describes your situation.

You can't accept a job though until you have your EAD.
