Delayed I-130 almost ONE YEAR!

Hello everybody! I have been reading a lot of other people's stories on here and figured I would write my own and possibly get some answers or feedback of what you think is going on with my case cause I have noooo idea. So to start off from the beginning...Last year I met my husband while he was in America on a tourist visa within a few short months we were married and looking forward to starting our lives together. However within the first few months of our marriage he was required to go back to Jordan because the visa he came to America on was due to expire. At the time we were unsure if he could legally stay here just because we were married so we made the hard decision for him to go back and we would wait about 7 to 9 months for him to come back. Well what we had in mind not even came close to what we have been going through this past year. I filed for the I-130 petition in November,2010 and still have not received a decision of approval or denial as of today, almost a year from now! My I-130 at first was being processed in the California Service Center, then supposedly transferred to the local Newark office and now to the Vermont Service Center for "further processing and review". I haven't been contacted by anyone from USCIS regarding my case I have only gotten answers from constantly calling and emailing anyone I could. So not wanting to wait any longer to see my hubby I went to Jordan a few months ago and have been contacting people from here. I've had nothing but problems has anyone else been through anythingg similar??

We filed for my K-3 (which existed back then) in early 2007. The I-130 that was part of it (and CR-3 would we have gone with that route) was finally approved in the mid-2009. In 'barely' 2+ years. That time sucked big time every day.

If either of you, or anyone with a matching name and dob (and if the name is common, or there are several ways of spelling the name with the Latin alphabet, the likelier it seems), is in any of the special (not just immigration related) watch lists, the wait can be long and frustrating, and USCIS didn't seen too keen in giving any updates, even for the bigger names prompting for an update.

See if you can get any senator etc to prompt for an update for your case. It's worth seeing if it can speed them (USCIS) up a bit.

Best of luck - I hope your case is just stuck in a regular backlog and not because of some John Doe with the same birthday as one of you and who's in some unknown list.

Thanks for sharing your experience! Do you know if I could apply for a K-3 visa for my husband even though I sent in my I-130 last year? I've tried my Congressman, Senator and Obudsman from the USCIS as well as emailing the service center where my case is at the moment. I don't know what other route to take other then just waiting it out and I am becoming soo impatient with this form. Thanks again :)

Try to find a local charity that does pro-bono immigration cases - then ask about writ of mandamus - this forces USCIS to adjudicate the case.

What happened with Congressman or Senator? You have to pick only one to represent you in front of USCIS - they won't meddle if someone else has already started the inquiry. DId you send the release form authorizing them to act on your behalf alongside your NOA1 and any cover letter detailing your case? Sometimes you have to go in person to your local office of the congressman/senator and speak with their immigration aide - have to follow up on everything done and ask to be forwarded any emails they get from USCIS.
