Timeline

I've been married for over 3 years now, and I also have a 2 years old son, I came here with a K1 visa but haven't filled for the AOS yet as we are tight in cash. Is anybody here have any experience in filling late? Will this be a problem when I eventually file, yours response means a lot.

You will have to follow this

I would file as soon as possible - with the rising change in immigration laws (State wise) - you could have some issues.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Why file under that? As long as they married within 90 days of arrival, they should be ok. It might take some explaining waiting so long though, but it will be $1070 well spent.

K1 Journey

15/07/2010 - We finally put in the i129f application - after shortly considering me going there on VWP, marrying and trying to Adjust Status, but was too risky

03/01/2011 - NOA2 on the day Dawn returned to NY after spending Christmas with me

10/02/2011 - I visited NY for 3 weeks (let this hold up the K1 process)

28/02/2011 - Medical

29/03/2011 - K1 Interview at London Embassy - Visa granted!

01/04/2011 - Visa in hand

Next Stage

03/05/2011 - POE in JFK - can't wait!

04/06/2011 - Our Wedding Day :)

I do not see any problem as long as you married within 90days period based on the law. You can file your adjustment of Status at anytime as long as you came with K1 Visa and married the petitioner within the time frame of 90days. Nothing will stop USCIS from approving your case based on a good faith Marriage even if you decide to file after 1 year or more. The laws have change now to favour K1 Fiancee visa applicants who came to the US and married their petitioner within 90days in good faith and later filed after many months of Marriage with evidence of good faith Marriage.

That is incorrect. The USC spouse will have to file the I-130 along with the I-485 due to the length of time that has elapsed since K1 entry.

You were totally wrong with your information (Topic summary). Please read the recent update of Immigration update of the applicant that arrive on K1 and married the petitioner within 90days of arrival. Please do not confuse the applicant.Please make your research very well. The immigration Laws on K1 fiancee applicants who arrive in the US and married the petitioner can Adjust status even after many months or years. As long as he or she marries the petitioner within 90days in good faith,he or she can file the AOS on her own even if divorce occured.
