Hola fellow DFC applicants.

I am new to all of this and I have some questions.

I am an American currently living in Mexico and my boyfriend and I are getting married.

We would like to be able to go home to the states to live later if we so desire.

My question is if we get married here in Mexico do we then file for the DCF and eventually

go to Juarez for the interview? I am from El Paso, so is it possible to stay in El Paso

during the interview process and travel to Juarez each day to go to the interviews at the consulate

or do they take my fiance's passport so he can't leave the country?

My second question is this. My roommate was married to an American in Las Vegas but currently lives

here with her son and myself. Her husband lives in Las Vegas. She would like to go live in the states

next year with her husband. Does she also need to file for a DCF Visa since she was married in the States?

Does it matter where you get married? Whether you get married in the USA or in Mexico do you still file for

the DCF in Mexico?

It is all very complicated and hard to understand and as a newbie I would really appreciate some help.

DCF has nothing to do with where you got married.

You can only do DCF if you are legally living in the same country as your spouses lives.

Your friend cannot file DCF, her husband does not live in mexico he lives in the USA. Her husband needs to file for a CR-1 and she will wait out the process in mexico.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

No to file DCF you cannot live in the USA.

The USC must be living in the country of the spouse legally.

So if you want to file DCF you must be living legally as a resident of mexico.

I just spoke to the information hotline that is posted on the Embassy website for the Cuidad Juarez consulate

and he told me there is no such thing as a DCF. Only the CR-1 filing a 130 and I can file that in the USA or in Mexico he said.

I told him I have seen this DCF all over several websites but he said over and over there is not such thing.

On the website is says this it the same as a CR-1 but that instead of it taking 9 months to complete it only takes 3 months

so not sure what is up with that.

It sounds like he thought you didn't understand that it's an I-130 filing either way. The question is whether you file directly to the USCIS office in Ciudad Juarez (taking maybe 3 months, depending on many factors) or if you file to the lockbox in the US (taking 8-10 months).

If you have been resident in Mexico at least 6 months and are married, you can file an I-130 via Direct Consular Filing since there is indeed a USCIS office in Juarez. You need to be resident there at the time you're filing. If you (the petitioner/the USC) move before filing, you need to file to the lockbox in the US. Is it clear now?

Hi Barbi,

The previous poster is right. DCF is basically for Americans who live abroad and want to file for their spouse / fiance(e) / family member. Since you reside in Mexico that would qualify you for DCF, but you must have proof of residence (phone / cable bills, bank statement etc.. with your address on is) and you must also have a valid FM2 or FM3 visa. DCF just means that you file your paperwork abroad in the foreign country you live in (Direct Consular Filing)and the main advantage is that you can usually get the visa much faster than if you file your paperwork in the United States. In short, no one has to file DCF and in fact, not many people are eligible to file that way. The other option obviously is to just file everything in the United States.

You can get married in Mexico or in the US if he has a tourist visa. You wouldn't have a problem with the plan you described about going from El Paso to Juarez when he has his interview there, however they will take away his tourist visa once he attends the actual visa interview. So eventually he would not be able to leave Mexico until he got the immigrant visa.

For the other question, you friends Husband in Las Vegas (I assume he is the American) would need to file an I-130 for her and most likely for the son and he wouldn't file DCF since he doesn't live in Mexico. He would file everything in the United States.

02/04/2004 - A young Zinker arrives in Mexico to study Spanish and the dating game begins

2004--2005 - Many subsequent visits to Mx ensue to be with my love; engaged in March 2005!

04/??/2005 - I-129F is filed from within the US

06/09/2005 - Zinker moves to Mexico

09/??/2005 - I-129F is approved

10/15/2005 - Interview in Cd. Juarez and subsequently approved for a K1 Visa!..But visa is left in Juarez

10/17/2005 - Due to unexpected pregnancy and a job offer in Mx - we decide not to pursue the visa and it expires :(

01/04/2006 - Married in Mexico

10/09/2011 - Two children later and a comfortable life in Mexico... Preparing to file I-130 in December 2011. Stay Tuned!
