There is no such thing as CENOMAR for a USC. Unlike the Philippines the US doesn't keep a centralized registry for marriages so the federal government doesn't issue it- no NSO or such kind here.. CENOMAR only applies to Filipinos. Some people need to stop feeding false information. K1 applicants or petitioners are not required to procure or submit a Legal Capacity . You only need a Legal Capacity from the embassy if you are applying for a marriage license in the Philippines which obviously doesn't apply to a K1 since its a fiance/e visa.

I'm not in the Philippines how can I get it?

You don't need it to file the I129F in the U.S. she will take it with her for her interview in Manila which is much later.

When you file your paperwork make certain that you send clear copies of ALL pages of ALL your divorce decrees(if more than one), every page of each and make certain the stamp and names are visible.

My wife and I were married 1-1/2 years ago in the Philippines. She had to obtain a CENOMAR from her government before marriage. I had to go the US Consulate in CEBU and obtain an affadavit that I was eligible for marriage. I had to present certified copies of my divorce at the consulates.

Then we had to go to her town offices and apply for a marriage license where I had to give them the affadavit from the consulates. We then had to wait another 10 days before we could get married. Actually it was very easy because I came to the Philippines with the necessary documents and immediately went to Cebu to the US consulates because Cebu was located closer to her home.

Please allow me to settle this.

CFO does not need:

> A CENOMAR-- from the NSO.

> Legal Capacity to Contract Marriage-- from the Embassy.

CFO needs:

> A copy of his divorce papers.

> A copy of his federal income tax return/ tax transcript showing that he filed as single.

Thank you.

John--Hi, I am in 100% agreement with Tahoma. Previous VJ posts describing CFO experience support Tahoma's description/response. Additionally, my fiancee recently attended the CFO seminar and she was asked to show proof of my (never before married USC petitioner) singleness. My fiancee provided copy of my federal income tax return/ tax transcript showing that I filed as single. This was accepted at CFO as adequate proof. Another CFO seminar attendee at same session was asked to bring copy of her fiance's divorce papers. --RK

Legal capacity to marry? how can the USC get it if they are not here? They do ave website and they should be particular on what they ask before making people go there whewww....but anyways, isn't the divorce decree with court seal enough for them? CENOMAR for USC???? doesn't make sense unless they may had seen in divorce paper that the USC had previous marriage in the Philippines...IMHO :D

You would need the legal cap to get married only if you have made the decision to marry in the Philippines. As the USC, you do not need to furnish any more documents than you already have.

There is no such thing as a CENOMAR for the US citizen for a K-1 visa.

You NEED to rephrase your comment! There is such a thing as a cenomar for a us citizen but it isn't needed for the K-1 visa application

OMG!! YOU people need to get your facts straight! Where did you get this information that a USC cannot get a cenomar! I got married in the Philippines in January of this year and I needed to go the US embassy to get the affidavit of legal capacity to contract marriage but I ALSO needed to go to the NSO to get a cenomar in my name before I was allowed to get married! But no I have never heard of a USC needing to get one for a K-1 visa application. Before you make a post how about you make sure what you are saying is indeed the facts otherwise you just make yourself look ignorant!!!!
