Can we switch to a CR1 visa ?

Hi everyone, my fiance and I are currently in the K1 visa process ( we haven't had the interview yet) but we are finding it so frustrating and costly. I am thinking of calling the K1 visa off, marrying him in France and then reapplying for the CR-1 visa. Is that a viable option and if we get married there ( which doesn't cost as much in the US)? Does the CR1 visa cost as much as the K1 and the adustment of status.

One reason for doing this is the economy here in the US. After reading through the forum of applying for adjustment of status ( which takes months), I am so discouraged. I cant support both of us while he is processing the AOS and I know that finding a job in the US is going to be difficult right now. I just don't know if he should stay in France and save money.

This is a personal decision on your part. The documentation you will need to provide for both processes will not vary significantly.

Is the time and money you have invested in the K-1 process worth abandoning in favor of pursuing a spousal immigration visa?

It will probably take longer to start over with a spousal immigration visa. However, the K-1 and AOS route means he will not be able to work for 3-4 months after he comes to the US. A spousal visa means that he can work immediately when he arrive (in reality when he gets a Social Security Number in 4-6 weeks after arrival).

If you have already invested 5-6 months in the K-1, I think it might be best to keep going. But I don't know your personal circumstances. You need to decide what is best for the both of you.

hi Jojo, thank you for your help. The adjustment of status is only three-four months? I thought it would be longer.

You can apply for an Employment Authorization Document (EAD) when you apply to adjust your status. The EAD will probably come before your AOS is completed. The EAD will allow you to legally work before you get your green card.
