What is spouse refused to sign I751 but sent letter of support.

They are past the deadline of their 6mos period, and the USCIS said that they are just working on February's application. We didn't send ours off until April. So that puts them like 47ydays behind. Has anyone ever gone through this before if so please reply. But i'm telling you up front right now don't ask any questions such as why didn't you want to sign. I'm not going into to that at all. I'm i in love with my husband and he with me only ALLAH himself knows the true answer and I'm not here to be battered or condemed.

The Removal of Condition will be denied if the US citizen spouse does not sign the I-751. This means the conditional green card will expire, and the spouse must leave the US.

Removal of Condition must be filed jointly by the LPR and the USC. There are only four exceptions allowing the LPR to file alone; 1) USC spouse died, 2) divorced USC, 3) LPR is battered spouse, or 4) termination of LPR status would create an extreme hardship.

If none of the 4 exceptions apply, the ROC will be denied if you do not sign it. A letter of support is meaningless. If you want to support your spouse in ROC, then sign the I-751, otherwise you are not giving the needed support to keep his green card.

Agree with Jojo, the ROC will not be approved. Since you don't want to mention details it is difficult to advice further but if a divorce is in process, an RFE will be sent and the divorce decree can be submitted then.

Agreed, if you are not divorced and are not claiming to be a battered spouse, your ROC will be denied, your permanent resident status canceled, and you will be deported.

If you don't sign the immigrant's application will be denied, their LPR status is revoked, and they are deportable.

On the other hand they can file an abuse claim against you and get it that way, or you can divorce. Neither of those options require a spouse signature.

A loving spouse who wants their spouse around would have signed it (especially as at thsi stage the I-864 is already "locked in" so there's nothing really to the forms except a signature UNLESS you take issue with claiming to be a happy couple by signing it). There is no point though in anyone asking you "why" you wouldn't sign because the answer is easy. You either want your spouse deported, or you just don't care about them one way or the other. In which case get divorced and give them the chance to file without your support the PROPER way.
