My wife lived in Bolivia and didn't meet the poverty guideline so we had her father as a joint sponsor. We failed to submit his latest W-2 because they had some problems giving it to him.

We just got a letter with a 87 day deadline that asks for all her tax documentation(which we submitted), her current income(which we can get) and the joint sponsor W-2s(we are working on getting) and 1099(he doesn't use those)

My question is to how to do this the right way. It was clear that my wife didnt meet the poverty guideline and that's why we have her dad do it, however they told us that she doesn't meet it. Did we have the wrong order? We had my wife as the sponsor and her dad as the joint sponsor

Any input would be appreciated

Request transcripts from the IRS for both people. These are free & superior to the other documents. Obtain them by calling IRS or by using IRS web site. They will mail or fax. Or the USCs can go to an IRS office to get thyem.

no, the order is correct, but if she worked and paid taxes, even though it wasn't enough, then she should have submitted taxes. letter from employer, and the rest of what was requested. if she didn't work at all she should have put on her i864 that she made $0 income and a letter explaining why. what did her dad send with his i864? did he send his taxes or tax transcripts?

you don't say what documentation was presented with the forms.

We submitted all the requested from both of them, we didnt have her dad's latest W-2 but we did fill her i-864 with her income. now we will add the latest income that we didnt have before

The W-2s are part of the tax return. A complete tax return includes the IRS forms like the 1040 and the W-2s and 1099s. Basically a tax return is anything that is required when filing which includes the W-2s. Missing the W-2s means you sent in an incomplete tax return.

A tax transcript from the IRS is an acceptable alternative to a complete tax return. For those with missing W-2s, this is the best route.
