Hi Vj members

I have CR1 and my child has a CR2 is 19 yrs old, and outside US with REP....what happens to his status when I file for VAWA?

and does his age "freeze" to the age I apply to vawa or to the age he is when approved? (hopefully approved that is....)in case the processing time takes long and he will be 21 by the time vawa approved?

any recommendations to good vawa lawyer or pro-bono firm?

If you entered the US with a CR-1 Visa then why would you need to file for VAWA?

You already have a Greencard. If your Child has a valid CR-2 and hasn't entered yet they simply need to enter the US to get their Greencard.

It is conditional green card, valid only for 2 years

Does anyone know about the child age issue related to VAWA?

You can file for ROC (for the ten-year-GC) on your own once you have filed for divorce. I am not sure but if you're filing under VAWA, I believe you'll have to prove that the abuse was the cause of the dissolution of the marriage. Some one else will come along and provide details.

It's much simpler to simply file for divorce and the Remove Conditions asking for the Waiver of Joint Filing based on divorce.

All you need to do is prove you entered the marriage in good faith by demonstrating that you co-mingled finances & cohabitated during the marriage.

If you File to Remove Conditions based on Abuse then you must also prove the abuse.

Your CR-2 Child's ROC will be the same.
