Timeline

To keep it short, I got divorced from the man I went through the k1 process with, have since remarried. My green card is in my ex's last name. I'm returning home for a month because my father is very ill. I've already booked and paid for my flight my worry is that they'll give me a hard time coming back into the country. i have the following doc's that I will be taking with me.

Green card

Divorce decree

marriage license ((for my new marriage and my pervious marriage))

I also have my US Drivers license and military ID ((with my new name on it))

Has anyone else gone home and returned after a divorce? I'm a lil worried they will give me grief about my green card not being in my current hubby's name.

any advice would be great. Thanks :unsure:

The green card should be in your current legal name. Ok, I was told my someone in the USCIS office in hawaii that I didn't have to change the name on my green card, I hadn't planned to go home so soon, but this was unexpected. I'm leaving in 2 weeks I know that process will take a lot longer... any way I can get around it? I'm totally freaking out now.

You could ask at the local CBP (closest international airport) office what they would need to see when you were re-entering the US. http://www.cbp.gov/xp/cgov/toolbox/contacts/ports/hi/

I'm starting the paper work to change my name now, if anything I'll just change the dates of my flight... and hope my dad does ok while everything is being processed

You'll be fine with it in the "wrong" name. When I travelled home it was in my married name, and my passport was in my maiden. I had no questions or issues. The only problem I see is what name you booked your tickets in... they either need to match the passport, or GC, if they do, no issue. Still take the docs you have though.

I would not wait. You have the evidence proving the name change, and, add to that, there's no LEGAL requirement to change your name (either through divorce or marriage). So, what name is on your passport? and what name is on your marriage licence? USCIS will NOT deny you entry simply because the name is a little off. They might pull you into secondary, they will look at all your documents, you will explain the urgency which meant you couldn't change it in time, and also that you were told you didn't HAVE to change it (esp. given the fee). You could also start the I-90 process, go to biometrics and make an INFOPASS to get an I-551 stamp and leave while they're making your new one... that way you don't hve to hang around for 3+ months. Personally I would just leave and enter with the present GC and worry about changing it when you get back.

This thread: http://www.visajourney.com/forums/topic/334347-no-status-change-for-i-90-replacement-card-application/page__view__findpost__p__4954505 this person is waiting from August. If your father is ill do NOT wait. Either start the I-90 process, or leave as is and risk it.

**Edit - you mention in another thread that you've been an LPR for over 5 years so you're eligible for USC. I wouldn't waste the money on an I-90 and instead would file for USC with a name change (you also mention that is your aim for the future).

Well my husband freak out about it all worried that I wouldn't be able to come back into the country. So I efiled the I90 last night I'm going to make an info pass appt. And do the I-551 stamp. I also cancelled my ticket. I saw the wait times for the I90, they suck, I'm hoping I can get over there sooner than later.

Okay well that's fair enough :) It'll take around 2 weeks to get your NOA1 (possibly longer) and then maybe a month to do the biometrics. Once you've done the biometrics you can leave. There'll be no interview and you can re-enter with the I-551 stamp. You can also try expediting the biometrics when you make that infopass with proof of your fathers ailing health.

Do you reckon I should wait until I have the Noa1 to make the appt. ? I just found out my grandfather passed away last night... I so wish I had done this all sooner...

Normally without an NOA1 they can't do anything but given the situation I would try, at least to get an I-551.

well I just got my NOA1 in the mail! my evidence was received on wednesday and I got my NOA1 today this is the fast NOA1 I have ever received, I'm just waiting for my Bio appt. letter I'm crossing my fingers they give me an fast date then I'll go and make the info pass appointment! my hubby has decided to come with me so we have to work out his passport and time off work ect. I hope it all alines... thanks for the advice!
