There is no possible way to have him tag along.

I think you will have to petition him at the same time but I would hope that under special circumstances they would not leave a child in a alone by themselves. I think some legal advice would be a very smart thing to do.

good luck and I would love to know how this turns out.

Legal advice won't help, petitioning at the sane time won't help.

You can't petition for your brother as he is not considered to be an immediate relative of a USC.

there is nothing you can do, you can file for your mother and as ricardo said, then your mother can file for him. there is no way that they can come together.

if you filed for your brother separatly, it will take more than 10 years.

This is correct. The only family based visa categories that are not submit to numerical limits are parents, spouses, and minor unmarried children of US citizens. Congress compromised when they allowed that those types of immediate relatives would not be submit to numerical limits - they don't allow derivatives to "tag along". Every beneficiary needs a separate petition. A brother of a US citizen doesn't fit into one of those immediate relative visa categories - they fit into the F4 family preference category, which means many years waiting for their priority date to become current. It would be considerably faster if mom files a petition for him as soon as she arrives and gets her green card.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
