co sponsor qualifications

HELLO EVERYONE,

I WAS NOT WANTING TO HAVE A CO-SPONSOR BUT I JUST HAVE A STRONG FEELING I SHOULD GET ONE. BETTER TO HAVE ONE NOW THEN HAVE TO GET ONE LATER AND CAUSE DELAYS. AS FAR AS SPONSORS I HAVE TWO IN MIND. ONE IS MY SISTER BUT HER INCOME IS BASED OFF OF DISABILITY (2,000/MONTH)AND FINANCIAL AID FROM SCHOOL? WOULD THAT BE OK SINCE IT IS GOVERNMENT FUNDS? THE SECOND IS MY DAD HE IS A CARPENTER THROUGH THE UNION AND MAKES GREAT MONEY BUT IS LAID OFF FROM TIME TO TIME AND DRAWS UNEMPLOYEMENT OCCASIONALLY...AGAIN GOVERNMENT FUNDS? WOULD EITHIER OF THEM BE AN OPTION FOR ME?

The only restriction is that means-tested public benefits cannot be used, so the disability and unemployment funds can be used. The financial aid from school is probably not viewed as income so cannot be used. In other words, does she claim it as income on her tax returns--I think the answer is probably no, so it cannot be counted.

The rules in i-864 do state that disability(SSDI) not ssi can be used to meet the burden but the embassy can deny it if that is the sole source of income because i know of someone that happened to. i think it all depends on your embassy who ultimately has the discretion. i am not saying that to worry you just wanted you to consider that. i think the reason was given that if the beneficiary became a public charge they would not be able to garnish a govt check. we used ssdi to meet the guidelines but their was also a stable salary with it.

I think they should deny affidavits when all the people use is their ssi and unemployment to try to show they meet the minimum income requirements. Obviously, you aren't making any money and living off the government and more than likely so will the people they petition for, at least until the beneficiary gets an ead or green card, then they will work and take another job america doesn't have.

So eithier choice is an option but using my sisters dissability would higer my chances of not being accepted.Using my dad would be much stronger since he has been a carpenter for more than 20 years and only relies on unemployement when the weather or season of year dosent permit him to work or limits amount of work available. or what do you feel?

I agree with you that is why I am trying to be very cautious on how I handle things in my case. I meet the financial guidlines now but in the last 3 years that is not the case. Because of the past 3 years fluctuating and being well below the requirements. I feel it is in my best interest to have a sponsor just incase they request it. I was adopted and I am very limited on options for sponsors. the majority of my family is deceased and being that I am much younger than all in my family, most are retired or not earning income that could qulify them as a co-sponsor.

There is nothing wrong using the disability income so long as it is over the minimum for the number of dependents. If you father is way over the limit even with periods of unemployment, that would work too, but it really doesn't matter where the income comes from so long as it is not means tested.

In other words, she counts everybody you have listed. That's six people so far. She and her husband (household member) will need to make at least $37,487 annually to be an acceptable joint sponsor. http://www.uscis.gov/files/form/i-864p.pdf

Sory about the caps, thank you very much for the advice. Do you see the fact that they both rely on disability as the only sorce of income it will be an issue?

really i would go with your dads income it seems much stronger unless ofcourse as jojo pointed out the household size makes you ineligible. plz see the poverty guidelines for 2011 and consider all factors. i wish you the best i know how stressful this all is we have all been through it. :)
