Yeah he has had so many blood tests this year with the cancer stuff and through the medical and they have that. Just willing to do anything to help. We will get tons of character witnesses from close people. and Dan, yes I know I was looking forward to all of us seeing each other!

So do you think we will at least get the interview? or can the deny it before it even gets there?

He will definitely get the interview. The Consulate has a fudiciary duty to conduct the interview based upon the approval of the I-129F petition from USCIS, so the bottom line is that your fiance will get his "face time" with the Consulate.

Your fiance needs to prepare himself for the interview because obviously this will be a major point of his conversation with the Consulate. As I stated before, if he's honest and contrite wirh the Consulate and has some good character references then the Consulate may look past the lie to the medical officer.

I would also write a letter to the Consulate as the petitioner stating the facts about this and explain that you're completely supportive of your fiance, you've known him for x years and that you know for a FACT that his prior drug usage is not at issue now.

i believe you will get an interview and you will get a chance to explain everything.

i dont think the problem here is that he has tried drugs... the problem is that he didnt admit to it on the form so he needs to show them that he is of good honest character and it was a genuine oversight so i would definitely agree with az110965 and get character references.

My guess is that all will be fine. The medical may call you back to have a drug test or even further evaluation for addiction before they sign off. He misunderstood the question. Normally besides the form, they quiz you verbally so maybe they think he wasn't honest with them because they asked him about drug use. The embassy will likely understand it was a mistake and forgive the misrepresentation bit.

Concerning all his blood tests--Blood tests for cancer and the medical exam are specific to what they are looking for---blood counts for chemotherapy or cancer markers, looking for STDs (immigration) so they wouldn't necessarily come up with drugs unless they were looking for them.

For my fiances medical he checked off the box that he had not misused or abused drugs. He thought that he was answering honestly because he considered abusing drugs as currently using them and relying on them. In the past he tried ecstasy experimentally, once, when he was 17. From previous medical records that we also sent in for his medical it does state on there that he has tried drugs. He got a phone call today from the Medical office asking why he lied and that could cause us not to get out visa. He explained everything that I just wrote above. They said that they would keep in touch, but according to my fiance the lady on the phone didn't seem very happy.

Will this keep us from getting our visa? I read somewhere about a life ban from the US is this true? For something he did once when he was 17? I'm just confused. Does anyone know anything he could do to possibly help the situation?

Did I miss something here? Is he saying he no longer uses drugs? How would the Medical office know he lied or not? Certainly it can't be from a blood test because drugs wouldn't be in his system if he's not using. If it is from a blood test, then that's a different matter entirely. I think to make a strong case at the interview, you need to know in detail how or if the Medical Office knows he is lying or not.

You missed the part of the OP's further post which stated that the fiance had submitted medical records from cancer treatment. Within THOSE records the extasy usage was noted. When the fiance told the panel physician that he had never used drugs he contradicted himself and THAT is where the issue lies.

As of now, we have several people writing statements about him that we can bring. I myself will write one as well. Because his usage really was a onetime thing, there is no proof of AA or anything like that. But he is going to tell the person administrating the interview that he would be more that happy to join AA or get regular drug tests, take a psychological test, etc. It's good to know that he will get his interview, I'm kinda hoping that it's in a time when I can come to be there as well (as I've read that London lets you take your fiance). I don't know if that really would help our case, but I figure me being there wouldn't hurt anything. :blush:

And just wanted to say thanks to everyone for actually giving advice and not just being like "your'e an idiot why did you tell" or whatnot. What's happened has happened and now we have to deal with it one way or another. Just have to keep telling myself that life goes on and even if he gets denied, it's not going to keep us from being together... I'll just be the one moving to a new country :)

i think it will be ok. the medical people saying they will keep in touch makes it sound like he will be called back for a drug test maybe which he will pass and i have to say that 'Nich-Nick's' advice is pretty much always spot on. i think Sam will soon be with you in America and you wont have to move to cold, wet, England lol :)

I read a case in this site, where the beneficiary (a canadian lady) admited about smoking weed when she was young, only one time, she said it in her medical interview. When the main interview came,they denied her the visa and she recieved a ban for 3 years to get any kind of visa and she had to take some classes about drug abuse.If she complited the program and wait 3 years, she can fill again. It was crazy cause she was truly honest, and only tried it once. Your case its a little bit complicated cause your fiance actually lie. But dont lose your faith, the only thing you can do is bng honest during the rest of the process and take the advice you think you need it most. People please! don't lie! they're gonna found out anyway. USCIS got pretty smart and well prepared people, they get access to everything and anything. When a fiance goes to a k1 interview they already know everything, ad I mean EVERYTHING about you. They used records, including dumb stuff like social networks to found out everything about you. And I don´t want to sound like if Im bng paranoic, but I know what Im saying. But hey! we cant blame them, after sep 11, they have to be very careful about the people whose trying to get in the US territory.

Keep praying and be honest, o matter what happened be honest. There's a case in the UK whose revieved his k1 visa, after having minor criminal records. He thinks he succeed cause of his honesty. My prayers are with you guys! God bless you!!!!

When I joined the army years ago, it was standard to ask recruits if they had ever smoked weed or used drugs etc. I think they used that question to rule out the people that said yes, for having bad judgement.

I have a nephew in the Marines, He made it through basic training with high honors. Got stationed in Hawaii. His first week there he smoked a legal product you can buy in the stores there but it is banned from use by marines. He was with about 12 others. It was a year and many honors later there was an investigation and he was asked if he smoked any. He felt honor bound not to lie so he admitted it. All the others lied. The others are staying in but he is being discharged with no benefits and equivalent to a felony conviction on his record.

Yeah, definitely going to try hard to prove that hes grown up now and has nothing to do with drugs. Hopefully they will have it in their heart to forgive and understand. I suppose we will just have to wait and see. but in all honesty, if he's banned for a year or so then we can deal with that. i can move over there for a bit and we can file again once hes gone through all the necessary stages. im truly just scared that it would be a banning for life. i dont want to be in a situation where we couldnt visit my parents together, especially once we have children. :(
