Hello to Everyone,

My Girlfriend and I are planning to get married here in the U.S. She is a U.S. citizen and I'm on a Tourist status. I would like to find out if i still have to apply for a tourist visa or can we just get married? If so what would be the things that i need to do or to provide. She wants to stay here because her mom is going thru some personal problems and she doesn't wanna leave her. Is it going to be a problem for me if we get married if I stay here with her?

Appreciate all your help. Someone told me about this website hope i can get feedbacks.

Thanks Canadian Wife, does that mean that there is a chance that I have to leave the U.S.? I had no intention of getting married before I came here for a visit, but now I think I'm ready. Don't you have any loose ends at home, such as a job, an apartment, a car, a dog, cat, gold fish, stuff, that would require you to return rather soon?

Yes loose ends do apply. Thanks Brother Hesekiel. Here is the fine end....again these informations that we give you here are entirely based on experience that people has gone through. USCIS has no problem if you marry here and go back, they have problem if you stay back. There`s where the questions arise. Now you would certainly have an interview during adjustment of status (AOS) where it is upto you to convince the officer that your marriage was legal and entered into with good faith and not with intention of immigration. Also that there was no intention of staying back when you arrived. Now in most cases with other evidences the question whether there was intentions of staying back or not , are not asked. But they may ask it. If you can prove that your staying back here and marriage was a impromptu decision and your staying back someway benefited her and her family, then go ahead. But in either case get married.

If you dont mind me asking which country are you from ? Why I am asking is for some countries we have seen fiances after marrying went back, applied for K-1 visa, came back and forth to see their spouses and then was finally given the visa. I agree to Noah Lot .... :yes:

If you did not come here with intent to marry, you can marry and apply for AOS. This is all assuming you didn't lie about having a girlfriend here or go through any inspections that might set you up for material misrepresentation. But if it's all as cut and dry as you have claimed, then you can marry and adjust status. You can't leave the country until you receive AP.

I always wonder how ppl come on B1/2 have no intentions of getting married and suddenly in months they come to an affirmative decision.

Sametime they dont have any loose ends at home and interstingly they have all the documents required to do an AOS already on them.

Simple....they had already 'changed their mind' before they left their country, and lied to our border officials or embassy officials as well...then they post on sites like this one trying to convince everyone that 'of course, I had no intention of marrying...' yet they likely brought 11 suitcases full of clothes, their B/C, school records, etc.....and they act positively astounded when people don't believe them....that 'sudden mind change' normally takes place right around the time they are clearing baggage claim.

I'm sure some people do have intentions. Other people plan to leave and realize leaving is painful, or fall pregnant, etc. Obviously having all the documents there is quite suspicious but many people do end up having to get things sent over from relatives, quit jobs unexpectedly, etc. Not saying immigrant intent doesn't happen because it definitely does but it's not always the case.

Part of problem is that these same 'mind changers' cause problems for their countrymen ... how? Because when the embassy finds out they are staying and in the middle of AOS (and USCIS sends notification of this event), that only makes the consular officials far less inclined to believe the stories they hear about somebody's supposed ties to their country and how those ties are far more important than their new American BF of GF....but statisically, the odds of somebody returning to some 'developing' country rather than 'change their mind' upon arrival in the US hovers somewhere around 1%....and it's their decision to conveniently forget about the promises or statements they made when acquiring a visa (or admission to the US) that then causes problems for their countrymen when they apply for visas using the same worn out (and untrue) stories.

I mean I can understand ppl would quit their job and just send an email to their boss etc . get help from family member in getting the documents etc.

To me there are still things like one needs to cancel the services subscribed too, close out appt, close out bank accounts or have power of attorney in place so some family member can handle it.

I mean who would do a power of attorney when they are visiting as tourist and has no intentions to stay?

I had planned my move still I find things which I did not finish and have to put it on list like when I visit back next time I need to take care off.

Also to me sudden decision can happen, change of mind can happen and ppl can get married, but to me those person would get married and return back home and start closing the loose ends there and then return back to US.

I know and lot of time I would challenge them, unfortunately there are also ppl who believe them and they call me I am Harsh on them and rude on them..... lol
