Name problem..

I have a problem with which name to be use.The name on Birth Certificate given by the hospital where i was born say, MARIA ELENA and that is on all of my documents(BC,MC etc,etc) but on NSO paper it is ELANA. .I was going to get a passport the other day using the name ELANA the one on NSO paper and DFA-Davao said, they can grant the name ELANA (nso), but ask 3 additional requirements: Transcript of Records in school, Voters ID (name already changed to ELANA (nso))and a POSTAL ID with the name ELANA (nso.) BUT the officer added: " ITS AT YOUR OWN RISK AT USEMBASSY" since your documents are MARIA ELENA (the one on BC), -those words made me nervous and confuse as my fiance already applied for I-129F with the name ELANA which is again the one in NSO paper. I had with me an Affidavit of Explanation from a lawyer about my name when i went there but the word: AT YOUR OWN RISK AT THE USEMBASSY for your fiancee visa, makes me real nervous and confuse as it thought an AFFIDAVIT OF EXPLANATION is fne. Hope anyone there have gone thru this situation and could shed light. .also DFA told me i can also use the MARIA ELENA in getting a passport and will file for petition on change name of first name but my fiancee already had filed the visa using the name on NSO-ELANA. The status of the visa is REVIEW ON RFE REPLY...waiting for NOA2..we got RFE on my fiances Divorce Decree.I hope anyone here has this experience this problem and can shed light. Thanks..
