Thank you newbie... yes it was the one used by my fiancee in filing I-129F which we already received NOA1 but whne i went to DFA to get a passport with in the name that is on my NSO and i also have affidavit of explanation from a lawyer but they told me that they will allow me to use that name and will just ask a requirement but it will be at my own risk at USEmbassy. It made me confuse.

does the name you use in your passport the same with what is on the nso???if so then dont be confuse just stick to that name.im no expert on this maybe somebody from here can shed light on this

Yes you are right i am supposed to apply the name which is on NSO paper and is also what my fiance applied at I 129F but i was confuse when DFA said at my own risk on USEmbassy since all my documents are in the name that is on Birth Certificate..so DFA said to better be sure on what name should i apply in passport. They can grant either one of the two names- BC or NSO provided i can produce the additional requirement they will ask but again she said, AT MY OWN RISK ON USEMBASSY.

If first name of Birth Certificate different from NSO paper, which one should be used in applying K1 visa? Anybody has gone through with this problem? Please help ...thanks

You are going to have a problem getting a passport if that's the case.

What does it say "baby girl dela cruz" instead of Grace dela Cruz? or just a misspelling? If the mistake isn't that bad and doesn't want to go thorugh an ordeal, (it's written as Gracie dela Cruz then you have to use the one from NSO. If you want to correct it then try these steps that suits you...

Contact a lawyer who will prepare the Petition for Correction of Entry.

Lawyers shall file the Petition in the Regional Trial Court. The fee for filing the Petition in the Regional Trial Court is Php 160.00.

The Petition will be raffled and assigned to a branch of the Regional Trial Court.

The assigned Regional Trial Court shall issue an Order for the publication of its Order in a newspaper of general cirsulation for three consecutive weeks. Fee for publication varies.

The Order contains the date of the first hearing.

During the first hearing, the lawyer will present compliance of the jurisdictional requirements like publication of the Order in a newspaper of general circulation.

After establishing compliance with jurisdictional requirements, the petitioner will be presented in Court to testify. The Court may assign the Clerk of Court to receive evidence.

During the hearing, i is possible that an oppositor may appear contesting the Petition. If o oppositor appears, the Clerk of Court will receive the petitioner's evidence.

After presentation of evidence, the Court will rule on the Petition.

If the decision is favorable, the Court will order the Office of Civil Registrar to correct the entry in the civil registry document (birth/marriage/death certificate of the petitioner).

The name on Birth Certificate say, MARIA ELENA and that is on all of my documents(BC,MC etc,etc) but on NSO is ELANA. . DFA-Davao said, they can grant the name in NSO which is ELANA, i will just produce the following: Transcript of Record in school and Voters ID ,name already changed to ELANA,they said Voters ID can easily be changed if the NSO copy is showed. But again, the word: "BUT ITS AT YOUR OWN RISK AT USEMBASSY" since all your documents are MARIA ELENA, -those words made me nervous and confuse as my fiance already applied I 129F with the name ELANA which is again the one in NSO paper. Again take note i carry with at DFA an Affidavit of Explanation from a lawyer about my name. Thanks for all replies. Hope anyone there have gone thru this situation.

its best for you to bring the affidavit from the lawyer when you have your interview

Hope anyone there have gone thru this situation and could shed light. .also DFA told me i can also use the MARIA ELENA in getting a passport and will file for petition on change name thats why yes,you are right about name correction, but my fiancee already had filed the visa using the name on NSO which is ELANA.Again, the status of the visa is REVIEW ON RFE REPLY...waiting for NOA2..we got rRFE on my fiances Divorce Decree..
