Divorce ??? Help please

Hi everyone, I didnt really know where to post this, but anyways I have a question. My uncle and his wife want to get divorced and they dont have their marriage certificate because it was lost long long time ago ( they got married in Afghanistan), so what should they do? can they get divorced without hiring a lawyer?? where should they go and what forms they should fill?? Thank you

When I got divorced I did it myself with no lawyer. I went to the courthouse and asked the clerk what forms I needed and she told me and even told me to go across the street to the print shop there and get the forms. I then filled it out and signed and then had the wife sign and submitted to the court with the fee.

Of course this is easy to do if there are no kids. If there are kids involved then most states require a separate lawyer for the kids. Also any and all divisions of property must be stipulated on the forms with no side contesting. In my case and some states allow it I asked for and received a expedited ruling and the judge signed off on it in his chambers. When he does make sure you go to the clerk and get the final judgement with a raised seal.

If they immigrated here as a married couple, I would imagine immigration was presented a copy of the marriage certificate. It might be worth at least asking immigration unless they are now both naturalized citizens. But even still, there's a chance that all those records still exist.

Thank you for your kind replay, it doesnt exist because my uncle and his wife come to States as refugees and they didnt have their marriage certificate, their house was burned in Afghanistan during the war and they fled the country with no marriage certificate. Yes they have kids, so what will happen to the kids???

It depends on the state they live in right now as Family Law varies from state to state. Common Law marriage is sometimes considered a marriage even if no ceremony or record of marriage exists, so the family court of their state would apply the same procedures to the children as they would in a marriage where there is a record. In any case, they're going to need to get some legal advice. Look in their area for community legal services to start with.
