she's been there for a while so me saying it might be culture shock it would be nonsense. send her home, or if you keep her and she divorces you after getting the green card dont be surprised :/

She already has a green card and the right to keep it, so he can't send her home. He already went through the AOS process with her.

My advice would be to take the infopass and give them all of the informtaion you can and tell them what you think her intentions may have been. It may not get you anywhere but it is better for you to provide all of the documentation you can before she does try something like a false VAWA claim against you. If she did enter this marriage with the intention to commit fraud I am sure she has a better idea of how things work than you think. Who knows depending on how long all of this has been going on for she may have already filed VAWA and you will never know.

From here on out it is not about revenge or about getting her sent home it's about covering your own butt as best you can. Take the infopass tell the what you think the circumstances are, give them the documentation to put in her file and move on.

02/05/09 - Extended return plane ticket to stay for an extra 3 months

04/23/09 - Decided we didn't want to be apart even though we extended the stay and got married!

07/23/09 - I called to have a service request put in

07/24/09 - I-765 Touched (FINALLY)

07/25/09 - I-765 CARD PRODUCTION ORDERED!!!!!!!! (About time!)

08/03/09 - EAD card came in the mail WOOHOO!!!

08/07/09 - Interview letter arrived

09/02/09 - Interview Date

09/07/09 - I think this is the day I received my Green Card.. Can't quite remember anymore.

There are two things:

Marital advice:

If you think you can't trust her, that she's using you, lying to you and doesn't care about you, it's time to end things ie divorce her. If your goal is to have a family, think of your kids, do you want them to have a mom like that? Things will probably get worse, not better, when she gets the 10 year GC.

Immigration advice:

1) She can file for ROC without you. (But does she know this?)

2) She sounds like a nasty person, so beware of a WAVA claim (in where she states that you have abused her and still get a GC). This does not have to be true for her to actually use this resource.

3) When do you have to file by? I think for her to file ROC without you she needs the divorce to be finalized before the application.

On another note, I've never understand this "send her/him home" thing. Not because your relationship didn't work means that your ultimate purpose has to be to kick out the other person out of the country as a "punishment". Of course, if she used you for a GC you don't want her to get "the prize" anyways, but you have to think what is what you really want: 1) end things with her because she doesn't love you? or 2) try to get her deported because she used you?

Case 1: just divorce her and move on with your life (beware of WAVA)

Case 2: Gather all your documents and make an infopass. Write a letter with USCIS informing of the possible sham. Get divorced.
