while waiting for K3.....can they come here?

After I marry my fiance... I will be leaving him and heading back to the US alone of course, but is there a way or a type of VISA to allow him to come here and wait while everything is being processed??? I can not imagine 6- months to a year or more away from my husband, even though I knew this was going to be time and money (trust me) But is there a way, because someone told him he could come here after 3 months, and wait while things are being processed?? I don't quite believe it, but it would be wonderful . He is from Guatemala, so maybe makes a difference too

There is no "come here and wait visa" despite what many people would like. He can apply for a tourist visa to visit but having a spouse in the US and a pending immigration visa application will count against him. He needs to provide strong evidence that he will return to Guatemala to complete the visa process and not just adjust his status on the tourist visa. An employer's letter, a rental lease etc would be examples. Do a quick search on the forums and you will find more information.

I'm not trying to be mean or in anyway diminish the time you will spend apart from your husband, but there are many people who have waited years to be with their partner. Additionally, by your own admission, you knew what you were getting yourself into. I suggest checking if there's a Guatemala thread in the forums and find out what the rate of tourist visa approval is there. If it's not great, or if he gets denied, it might be easier for you to go over and be with him.

Why the K-3??? its going to take longer and is more expensive and he cant work on entry.

Why would you not file a CR-1. Its cheaper not as long and green card on entry.

???? I need a lot more research, I know this.... because I obviously don't even know what to apply for Cr-1 ??? K3??? for him... The more I research, the more confused I am getting, but I have no money for a lawyer. I am unsure of the difference between Cr-1 and K3.

The K3 was originally intended to shorten the physical separation of the USC and his/her foreign spouse. However, the processing times of the K3 and CR1 are now very similar. The CR1's main benefit is that your husband will receive the green card upon entry in the US. If you go the K3 route, he will still have to apply for the green card. In short, the K3 is obsolete. See that's what I dont get.... why does ANYONE even go for a K3 then??? Is it maybe a Cr-1 is harder to get or may be denied easier??? If it is cheaper and takes the same time give a month or two maybe, then why would anyone go for a K3??? and want to wait getting a green card and working....???? The "someone" who told your husband he could come here after three months was simply wrong. He'll need a spouse visa to enter the USA unless he already has a B visa. My advise is to focus your imagination on your eventual life together instead of your time apart. It will make the time apart seem to go faster and be more bearable.
