Make sure when you submit your AOS from the K1 you submit a copy of the APPROVED NOA2 stating you have been approved for the I129F. It sounds stupid but we sumbitted a photocopy of Lizbeth's I94 with the K1 stamp, a photocopy of the ACTUAL K1, and her K1 approval from the consulado in Juarez, Mexico and received a RFE for the I129F approval. Can you believe that???

I guess USCIS does not understand that in order to get a K1 you need an approved I129F...anyway just a tip so you are not delayed.

I know it is documented somewhere on this site but couldn't find it in the AOS guide. It only mentioned to submit the approval for the K-3 there. Hummmmmmmm :wacko:

There was a thread on the old site that was documenting those and that change was brought up as needed to happen because the way the guide reads, it reads like it's K3 only.

I'll PM Capt. Ewok with this thread link so he might be able to do a fix.

If you look at the instructions for the I-485, on page 3 it specifically states under "evidence of eligibility" K1 visa holders have to send a copy of petition approval notice. Although this web site provides excellent advice for filling out the forms and such, I made sure to read the USCIS instructions thoroughly as well in case something had changed or was different from here. I have concluded that you have to read everything very carefully because the I-485 covers a wide range of people applying for AOS. We as K1 applicants have different evidence requirements than K3's or spouses applying for AOS without a visa.

Wish the USCIS would spell things out more clearly, cause it sure is complicated reading. :wacko:

::raises hand:: I am one of those who followed the guide and thought that the NOA2 was only needed for K-3's and then received an RFE... Luckily, it was a very quick RFE, but still a waste of time and set us back a little...

I did the same and also read several postings here where people had sublittled their checklist for AOS - many of them had the NOA2 in their lists also. I copied the checklists and added or deleted to it as I interpreted the instructions and our case. Good Luck
