Hey everyone, I hope i post this under the right forum and hope someone can help me understand the confusion in my case. In my case, I already file the paperwork and get to where they request the form I-134.

Now the consultant service my fiancee use in Vietnam told her that her evidences look weak - since we have picture of us going out, travel together but not many picture of other family member and since money was a problem, we exchange ring but never have an engagement party with both side family. So anyone know if there anything that we can do to make the evidence look stronger? any alternate route?

In addition, the consultant service say that they do not accept co-sponsorship in Vietnam and right now I am just start working on internship - I am a mechanical engineer student - so I can have the tax yet. My brother in law is help me file as a co sponsor. So does anyone know if it is true that they do not accept the co sponsor? The consultant service in vietnam told my fiancee to either wait until next year when I file my tax or keep going and have a very little chance of approve. So should we keep on going or should we wait on this?

Please if anyone can shed some light on my case. This is my first post so if anything wrong please forgive me.

Co-sponsors are not often accepted for K visa petitions in VN.

You should do a lot of reading here in the Vietnam regional forum to learn what is expected at HCMC. It's not an easy place. It's best to be well prepared. Lots of folks here with VN experience to lend a hand.

How many trips have you gone over there to be with her so far? If you have limited income, where did you get the money to finance those trips?

Btw, it looks like (don't take this personally, the C/O generally assumes this for most cases) you're strapped for cash and using the opportunity of an arranged marriage for some quick cash.

Nevertheless, they (the C/O) will make you play your game a lot harder by making you going back to VN and marry her and then sponsoring her via I130 (after failing your current K-1 petition). That process is both $$$ and time consuming. Be prepared for that stretch of the game.

And lots of good luck!

I have been there for 3 times (during summer) over the timeline of 5 year (2006 - 20011)and the money is either come from my credit card or my school loan. About the arrange marriage, I am understand but she is poor not rich. And thanks for the information about the married process. So would my chance better if I wait until I graduate (end of this year), file tax and process the paperwork then? Thanks a lot everyone.

Hello,

As Roger already told you, co-sponsors are not accepted for K1 visas. You will have to find the income and/or assets to sponsor your fiance by yourself. If you do not satisfy the income requirements, the Consulate will probably not issue a visa. If you did not have an engagement ceremony, that can be a big problem with the Consulate. If you can find the assets in your bank accounts, saving accounts, etc to meet the minimum requirements the best thing you can do is go forward with your K1 and bring as much evidence to the interview and hope that the Consular Office will accept the evidence. They have been known to reject evidence at the interview but this is pretty much your best chance.

If you file now then you'll probably be denied, and you'll end up spending a long time - maybe years - trying to get it fixed.

Take your time. Build your relationship. Save your money. Have a proper Dam Hoi, invite the whole village to the party, get a nice tux and gown, and hire professional photographers. Try to get a married couple from your family to come to VN and represent you. When you've got at least one tax return with sufficient income, current paystubs, a letter of employment, and big box of evidence, then go ahead and file the petition. Your chances of sailing through the consulate will be substantially better.

From your original post, I understand that you already filed the petition and are now getting ready to submit your I134. If this is true, I will say the chances of getting the k1 visa approved is very small. I do believe in miracles but I just want to be honest to yiu about your chances.

If you did not file your petition, please stop now and do more research to better educate yourself on the visa pricess. Spend more time with your loved one and have a proper engagement ceremony. Build up your evidence to build a strong case to prove your relstionship and put it with your petition. This assumes you did not submit the petition but if you already did, there is nothing you can do except bring as much evidence to the actual interview and hope the CO accepts it.....

This consulate usually will not accept cosponsors. In the years I have been here I have heard of one time they did accept it. You can try to go and get them to accept a cosponsor and not having an engagement party but your odds are slim as it stands right now.

No a lawyer can't intervene at the interview at all. They can't force the consulate to accept a cosponsor either. In fact usually all a lawyer is good for is to do the paperwork that you then submit.

If you haven't filed, wait and have a proper dam hoi and enough funds to satisfy sponsorship. If you have already filed, without enough income or funds, it is extremely tough. The only advice I'd say is to get as much evidence as possible, have a dam hoi if possible and be there at her interview.

Thank you so much for all of your response. As it stand, I already file the petition. I just recently found out about the co-sponsor. Now i guess is just wait for the interview to come since nothing much I can do. I will post back my process so anyone in the same situation can avoid any mistakes I have done. Thanks again everyone.

Jim is right, and I would add that the Dam Hoi is not for the case officer of the embassy, it is for you, your fiance, and your new family to celebrate and confirm the union. The reason it is important to the CO is it shows your serious commitment to the relationship.

Sounds like you are getting the cart before the horse a little bit. Slow down, build a solid relationship with her and her family, then apply to bring her here.

That ship has sailed. The OP already filed the I129 and is now at the Packet4 stage but has weak evidence and not enough income to support the petition.
