Questions..marrying a US soldier

Hey there!

I've been searching the forum for a while, but I can't find anything regarding my case.

I'm from Brazil and living in the US for almost 6 years

I came here legally(B1/B2 visa)

I've met, started dating and now I am engaged to the love of my life, who happens to be an army soldier.

He has a security clearance(not a top one - valid for more 9 years)

I don't have any criminal charges or anything against me.

My questions are:

How should I proceed after we are married?

He can get in trouble with his job or worse, lose his security clearance because he wants to marry me?

What he should do BEFORE our marriage? (regarding his job I mean..inform his command, security officers etc?)

He is NOT in the US at the moment (deployed to Korea) we will have to wait until he is back to the states or because he was sent there by the army, I can go to the interview without him?

I'm sorry all the questions...I am just really confused! Thank you!

Hey,

I will try to answer as much as possible. He does not need to tell them before he is getting married. My husband is in the marines and have clearance as well. Once you are married he needs to take the marriage certificate along with your birth certificate and drivers license, this is to verify that you are female. You will then be added and no problems. You guys being married will not affect anything. You can then get your military ID and healthcare and all of that. When you fill out the paper work, he might need to take it to there legal office but apart from that you will be in charge of it. You have to make the necessary payments and keep on top of the process. Yes you can go to the interview alone but you would have to bring a copy of his orders make sure by then you have bills and everything in joint names, they might require a second interview and wait till your spouse is present. I hope I answered all your questions, you can message me and i will try to help as much as possible.

First even before you go for interview he needs to be back in US for you 2 to get married. That would be the first step.

He cannot file a fiancé visa since you are already in the US, after marriage you guys will have to file for AOS and also for the wavier as you been in the country illegally since you entered on B1/2.

He would not lose his security clearance coz he is married to you, but depending on his work he might not be able to share with you what he does for the work.

Yeah.. he is coming here on his leave and we will get married..you've mentioned the waiver, but I thought that only would be necessary if I didn't have a visa?..Thank you!

I would not say that is always true.

He should check with his command - there are some military regulations that when the service member is outside the US, they may need to fill out a request form to marry a foreign national.

Your case is slightly complex, since you are currently in the US and he is outside the US. (if your both in the US - no issues.)

Don't worry - permission is usually granted 99.9% of the time, but again - it depends on the command - have him check with his on-base legal - and they can give him the info he needs.

He may also need a re-screen of his security clearance - again - depends on the level and what he is doing - legal would tell him.

Ex-Navy - so our command rules may be slightly different than Army.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Being in the Navy, there are some regulations, depending on the command,for junior personnel prior to getting married i.e. requesting permission prior to. I'm not so sure how the Army works. As far as the clearance issue, i've had recruits get their secret clearance disapproved for having immediate family including spouses that were citizens of certain countries....Cuba, Venezuela, China, etc...but again, we're talking about the Nuclear Program.

Depending on what clearance he has and where you are from, it shouldn't raise any flags during the re-screen , if they request one.

The only case where you would REQUIRE permission from the Navy or Army is if you plan to marry a foreign national OUTSIDE of the United States.

That's what I originally planned to do, marry my current wife in Colombia. It was too much paperwork involved including a background check and medical screening prior to even getting permission to marry, therefore opted for the K-1 route.
