When it comes to filling out the affidavit of support, I am having a bit of confusion. I know that I the OP have to file with the I-864 form as the primary sponsor. I will need the help of a co-sponsor and our co-sponsor is a retired couple. My question is...do my co-sponsors have to only fill out one I-864 together if they file joint tax returns. I do not live in their household either. Or if the husband's filed seperately from his wife on taxes, does he file the I-864 and his wife file I-864a to meet the goal for the 125% poverty level. I know the husband has enough with assets to fulfill the amount by himself. I guess my question is, do each of them need to fill out seperate forms or are they alright on just filing I-864 together as my co-sponsor

If the co-sponsor (if filed joint tax return) is able to sponsor with his resources, then just a I-864 from him/her is sufficient. Include the copies of the full joint tax return, which is better in this case then an IRS Tax Return. The proof of ownership of the assets showing their values will have to be produced. You don't have to be in their household or live at the same address. He/she need to submit a proof of his/her US Citizenship/ Permanent Resident status (if born in US, copy of his/her Date of birth else Naturaralization certificate or Green Card).

If the co-sponsor (if filed separate tax return) can use IRS Tax transcripts or the copy of his/her full tax return. This is the only difference and the rest are same as above.

If you want both of them to co-sponsor, then let the husband file I-864 and his wife file I-864A. You need to know how they filed their 2010, 2009 & 2008 tax returns.

01/08/13 - Approved and GC is order for production on 1/8/14

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

Your profile states that you are pursuing a K1 fiance(e) visa. Your question is posted in the CR1 spouse visa forum. Which visa are you seeking?

We got married under K-1 last Feb and he returned before we filed AOS, so now our only way of reuniting is through cr-1. We are filing for expedite also after finding out i have a tumor in my brainstem so things will start moving fast. I just want to be prepared.

If they file jointly, head of household provides I-864 and spouse I-864a. If they file separately, one I-864 should be fine.

He/she need to submit a proof of his/her US Citizenship/ Permanent Resident status (if born in US, copy of his/her Date of birth else Naturaralization certificate or Green Card).

What counts as proof of citizenship? I assume birth certificate or passport will be acceptable? Are copies of the proof ok?

Also, I'm being a little dense here but I just want to be clear: if your sponsor files a joint tax return, but his income and assets alone are enough to sponsor (while supporting any dependants), the I864A is not necessary? Or is an I864A required in any case where a joint return is filed, regardless of whether one individual earns enough to sponsor alone?

If one is born in US, then copy of Date of Birth or passport are fine. If one acquired citizenship through naturalization, then either a copy of naturalization certificate or passport are fine.

If the co-sponsor income or assets are sufficient, then just I-864 of the co-sponsor is sufficient - no need of I-864A from his/ her spouse.

This is true only if qualifying with W2 income and the sponsor supplies a copy of a complete tax return including W2 forms instead of a return transcript. Transcripts don't indicate individual income but a tax return with W2 forms does.

The plot thickens. Either is using the W2 income or having my mom fill out the I-864a is possible for us: is one or the other easier? Quicker?

If my parents file jointly, and my mom fills out the I-864a, will that make my dad 'the first of two joint sponsors' on his I-864?

Dad would be the only joint sponsor and Mom is the household member.
