AOS Interview

Hello!

We have an AOS interview in 3 weeks time. Our appointment notice lists the items we need to bring, including my wife's birth certificate. Unfortunately, she has no idea where this is and the processing times to obtain a certified copy from the county registrar will take 3-4 weeks so there is no way that we will be able to get a copy in time. Now it states on the notice that "failure to bring the below listed items will result in the denial of your application (8 CFR 103.2(b)(13)). It specifically states "Your petitioners birth certificate and your petitioner's evidence of United States Citizenship" - I am wondering, would it be acceptable to simply bring her passport, social security card and driver license in lieu of her birth certificate? After all, she had to originally provide her birth certificate to obtain all of these?

Any advice would be greatly appreciated.

I would call USCIS and speak to someone there and get their opinion. If need be then you can reschedule your interview. Assuming you have your EAD and AP then there is no rush. I hope that isnt being overly presumptuous. I know it isnt ideal but need must and your wife needs her birth cert to prove she is a US citizen, although her passport may just be enough, call them and find out. They are open 8-8. I suggest you do exactly the opposite of what Little Genee suggested: refrain from calling the USCIS mis-information line and talking to the Indian girl answering the phone, you know, the one that sent out over a hundred job applications but was rejected because she couldn't communicate in English well enough until USCIS hired her, and bring your wife's passport in lieu of her birth certificate in order to prove her U.S. citizenship. Important information: only U.S. citizen have a U.S. passport.

You can not obtain a US passport without a birth certificate, hence the passport covers the birth certificate and much more
