Hello!

My K1 visa just got approved (Yeay!!)and as I'm waiting for my passport to come back I'm working on my next steps.

The work permit and adjustment of status are still a bit confused to me.

It is said I can apply for a work permit (I-765) as soon as I enter the US.

We plan on getting married roughly a couple of week after I enter the US.

Is it worth it to send the I-765 or is it better to wait until we get married so I do it along the adjustment of status? I'm not sure if these two process are totally different (then I will apply as soon as I enter) and if I will need to re-apply for a work permit once we are married (then I will wait).

Once you are married, you can concurrently file AOS + EAD (which allows you to work) and Advance Parole (which allows you to travel outside the country).

You will need to wait untili you get married, as you will need to supply a copy of your marriage certificate.

Wait till you get married and apply after that. This way you will also save money as you will need to pay only for I-485 and AP and EAD is included.

While technically, you can apply for an EAD when you enter the US, it costs $340 (thereabouts) and expires 90 days after your entry. It also takes about 90 days to process, so you can see that you would be approved for work for maybe a few days and then the EAD would expire.

If you wait until you marry and file AOS, then the EAD is free and lasts a whole year. Once you have the GC you don't need an EAD anymore.
