I need help from someone familiar with 5 year law restriction. My wife and I supposed to have a big wedding which we kept postponing because my wife's parents had to get permission to leave Russia. Basically, my mother in law works for RosReserve, which is a government organization in charge of strategic reserves in Russia. She and her husband received 1 year B1/B2 visa to visit us. However, things got delayed because she needed permission from FSB to travel. It took about 2.5 months. In the end she got fired (!) and they took away her passport and forbidden her to travel outside of Russia for 5 years. Is there any way to appeal his? Anyone?

Yikes! Slim is right. Unless someone here has experienced the same it is probably better for you to consult with Russian legal experts.

I am afraid to go to the Russian side :( > I am afraid that FSB or someone will find out and it will only make it worse for her. It looks like this country is going right into dictatorship.. Maybe I will try to find russian lawyer here in CA... Now I am even afraid to let my wife go visit her parents: who knows what they will do!

i mean... there is a number of jobs that you do in Russia, which don't allow travelling abroad as long as you work there and 5 years after you're done working, but when they hire you, you're supposed to sign a paper, which says that you agree with that.

as far as I know, RosReserve works with TOP Secret information, so, I'm not surprised that they don't want to let her travel. I'm surprised that she didn't know that there can be such a problem.

Anyway, find a Russian-speaking immigration forum, there might be somebody, who had the same problem.

She was allowed to travel before. She traveled all over Europe and Israel, so this is not a problem. She supposed to ask for permission, which she did previously and this time as well.

No, she did everything by the book and she did get her pension, even though it is not "nice pension". They get paid pretty low.. She applied for permit 1 month before the visa application. She got her travel passport officially from her work (it is kept there) and returned it after receiving visa. This totally sucks as if she did not play by the book she would be fine. She is just such a Russian patriot that makes me totally sick...

5yr restriction is a result of the 'form # 1' access type, i.e. гос.тайна # 1. 3yr is the form # 2.

Once she receives 'uvedomlenie', she can appeal. Unfortunately, it's 1% of success.

Uvedomlenie indicates the followings: reason and duration of limitation, date, registration number of the solution, complete designation and juridical address of the organization, which is responsible for the limitation [can be diff from RosRsrv]

There are 2 types of contracts she could sign before they hired her - 'trudovoy dogovor' and data access. Trudovoy dogovor might not mention about limitations, but the data access contract must.

It is possible that neither of those contracts say something about limitations - even in this case, there is 1% of success.

Let's assume she signed a 'dopusk' (data access). Did she re-do it before she asked for permission to visit M. as described under 'г)' at http://bik-zgt.ru/pd.html ? Usually, FTEs (full time employees) dont do it, except the conditions described there.

If she missed it, or she wasn't instructed to do so, I'm afraid, she lost the job because M. lives here..

M. will be fine, she can visit parents w/o any problem.

Smart move. Last thing you want to do is go to a Russian site. They track the internet 24/7. One of their favorite tricks is pretending to be from the West when actually they are Russian posting from Russia while masking their IP. Their worse than the Chinese in this regard.

Thank you for the link. Yes, she did fill out document on Masha's immigration status when Masha left the country immediately. So, she did that for sure as she was asking me details of my job, etc. So, she did that.

Why not smuggle her out on a boat? She could fly to Vlad, hop a ship to Fairbanks, and disappear into the wilderness. You guys could pick her up, drive through a Canadian entry point (that's not even manned) and she'd be in the US within about six weeks.
