Greetings all-

I know it's early but this came up at the breakfast table this a/m - and feed back would be great.

I poe'd in Dec of 2010 - I filed income tax in Canada (exit return) and jointly with my husband in the us as we were married dec of 2010 Year filing 2009). I am collecting ei from Canada and that will be my total income for 2010 - Question: Do i have to file in both countries? 2. What amount - as the exchange re4ally makes a huge difference...depending on the rate of course it has been as low as $50.00 less then what the check is actually written out for...Just wondering if theres a % we can use to get a more 'realisitic' amount...Any ideas?

If you have already filed an exit return in Canada, you will only have to file in the US (Canada takes a 25% withholding to cover the taxes).

As for the exchange, you will have to convert you EI into US dollars. You do this by using the 'yearly average exchange rate.' Here is the chart from the IRS site http://www.irs.gov/businesses/small/international/article/0,,id=206089,00.html

Did you let the Cdn gov't know you are no longer a resident of the US so they could withhold the extra taxes as required?

If not, I would highly recommend you get in touch with the International Tax Services Office and ask one of them (much more experienced then the general inquiries agents are) what your requirements to Canada Revenue Agency are.

The EI people know one is not in Canada and they deduct 25% off automatically.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1
