Help Please AOS on B2 Visa, how much??/

I am currently in the US and I originally came here to just be with my husband for a short holiday but we decided I should perhaps stay because I became pregnant whilst visiting.

Anyway, I want to adjust my status from a tourist visa to get a green card.

I am just wondering how much it will cost and what forms we need to provide? We will be needing a co-sponsor too.

Few things about us, we are both 23 been married nearly a year, I am English and he is a citizen as of earlier this year.

Any help would be much appreciated.

you must pay the fee for the I-130 as well as for the AOS as well as for the medical.

I-130 = $420

AOS = $1070

Your medical cost will be whatever they charge you at the civil surgeon upwards of 300-400 $ or more for a full medical.

Are you actually here on a B2 or are you here on Visa Waiver?

If you apply from England, you would be filing for a CR-1 or an IR-1 depending on how long you have been married. The cost is cheaper overall, but I'm not sure how much so hopefully someone else can chime in.

Okay, just checking as the majority of people who are here from the UK are actually on VWP. In any case, here is the guide for the CR-1/IR-1, which you'd be using if you filed from England. You'd still be allowed to visit as long as you followed the rules of your visa, and when you entered the country after approval you'd already be a permanent resident.

I'm a little bit confused-are you wanting to apply for AOS and stay here, or go home and apply from there? I think the average processing time, no matter how you do it, is average of 6 months.

I want to stay here but I don't think we could afford to process everything. So I guess I'd have to go home and wait :/

One thing I just thought of. When will your baby be born? I really don't know this (someone else may) but if you give birth while in the UK, there may be separate paperwork to file? I really don't know. But something to ask about.

No, you don't. Someone with a CR-1 visa enters the United States as a permanent resident already. They do need to file for removal of conditions, though. K-1s and K-3s adjust status after entering.

That is stupid you do realise they file AOS at the NVC stage? thats why they have to process spousal visas so long in NVC so they can get the green card on entry instead of filing AOS once they enter the USA.

Um, AOS at NVC stands for Affidavit of Support which is form I-864. AOS in this case is Adjustment of Status which is form I-485.

You can't Adjust status here while going home to wait for the decision. Once you start the AOS process, you can't leave without Advance Parole until it is completed.

If you are wanting to start the CR-1 Process then yes you can start it here and then go home at the end of your visit to complete it.

Did someone else sign on with Inky's login? the $88 AOS is the affidavit of support or I-864 fee. Not the Adjustment of Status fee. For a CR-1 there is no adjustment of status.
