hi guys,

well, this is our problem :

we got married couple months ago after we fall in love and we are very happy together. now we decided to file I-130 for me the petitioner, and she is a US citizen.

she is still student and actually she is kinda sick and i think she will not work for many months, she will just keep studying till she graduate actually she lives in the US and i live in my country.

she does not have good relation with her family, so she will look to find a co-sponsor but it is not for sure, and it might take time for she can find one as friend or else.

so,my question is :

when the I-130 will be approved, how many months the NVC will give us for my wife find a co-sponsor for the AOS ? i mean what is the maximum time required by the NVC for to file the I-864 (AOS) ?

well it depends when she will send it. The process can take between 3 to 5 months. it can be even more. I think she should start looking now.

the max would usually be 1 year . Untouched petitions for that long are normally considered abandoned.

so you mean that it might be a red flag the fact to find a co-sponsor and send I-864 late ?

or it doesn't matter to send it after couple months from the USCIS approved I-130 ?

well, i mean in case when my wife will not find co-sponsor in that time :)

As long as NVC still considers your case to be open and valid (not abandoned), it doesn't matter how long you take to file the paperwork with them. As NigeriaorBust said, you would usually have about a 1 year window before the case is considered to be abandoned.

03/04/14: USCIS case status update: Card/Document Production (i.e. APPROVED!!!)

03/07/14: USCIS case status update: Green Card in the postal system; tracking number

03/08/14: Approval notice arrives in the mail (dated 03/04/2014; USCIS Office: Buffalo, NY)

03/10/14: 10-year Green Card arrives in the mail
